ברכת השנים

תקנו חכמים לשאול (לבקש) מה’ יתברך טל ומטר בימות הגשמים ב"ברכת השנים". ובארץ ישראל מתחילין לשאול מליל שבעה במרחשון, ובשנה זו (התשע"ב) ליל שבעה במרחשון יחול בליל ששי הבא עלינו לטובה, כלומר, בתפלת ערבית שבמוצאי יום חמישי, יש להתחיל באמירת "ברך עלינו", "ותן טל ומטר לברכה". וברכת השנים היא ברכה כוללת על צרכי בני אדם הנצרכים לשפע שיושפע אליהם ממרומים. ובכלל הברכה ענין הפרנסה והברכה שתהיה שרויה בכל מעשה ידינו.

הטעם שלא מבקשים גשמים מיום שמחת תורה

ואף על פי שהיה מן הראוי לשאול טל ומטר כבר ממוצאי חג הסוכות, מכיון שכבר נכנסנו לעונה הראויה לירידת גשמי ברכה, (ולכן אנו נוהגים להזכיר "גבורות גשמים" דהיינו "משיב הרוח ומוריד הגשם" כבר מתפילת מוסף של שמחת תורה), מכל מקום תיקנו רבותינו שאין לבקש גשם מהשם יתברך בברכת השנים אלא מליל שבעה במרחשון, משום שבחג הסוכות היו כל ישראל עולים לרגל לבית המקדש, ואחר כך היו חוזרים לבתיהם, ויש מהם שהיו צריכים ללכת בדרך לביתם עד שבעה במרחשון, ובכדי שלא ינזקו עולי רגלים מחמת הגשמים, תקנו שלא ישאלו גשמים אלא מליל שבעה במרחשון.

ברכת השנים בחוץ לארץ
בחוץ לארץ יש להתחיל לשאול טל ומטר בברכת השנים, מתפילת ערבית של מוצאי הרביעי בדצמבר למנינם, ובשנה שיש בחודש פברואר עשרים ותשעה ימים, יש להתחיל לשאול טל ומטר במוצאי חמישי בדצמבר, וכך המנהג באירופה ובארצות הברית.

ובמקומות שהאקלים בהם הפוך מארץ ישראל ואירופא, דהיינו שימות החמה אצלם הם בין סוכות לפסח, אינם שואלים טל ומטר בברכת השנים, וכן אינם מזכירים "משיב הרוח ומוריד הגשם" בברכת "אתה גיבור", ובימות הגשמים שלהם, ישאלו טל ומטר בברכת "שמע קולינו".

ולגבי ארצות שבהן עונות השנה הפוכות מאלו שבארץ ישראל, כגון ארגנטינה וברזיל, כבר דיברנו בענין זה בעבר, וכתבנו את מסקנת ההלכה כפי שנכתבה בספר הלכה ברורה, שדין בני ארצות אלה כדין בני ארצות הברית, ששואלים טל ומטר ממוצאי הרביעי או החמישי בדצמבר, וכתבנו שכן הסכמת גדולי הפוסקים.

שיש לשים לב בתפלת העמידה שלא לטעות בברכת השנים ובאמירת משיב הרוח

ויש להזהר מאד שלא יטעה אדם להמשיך בברכת השנים כמנהגו בימות הקיץ, שמלבד מה שבכך הוא בא לידי עון ברכות לבטלה, עוד שיש בזה חסרון בעצם הנהגתו שהוא מזלזל בתפלה עד שאינו שם לבו למה שמוציא בפיו. וכמו כן לגבי אמירת "משיב הרוח ומוריד הגשם", שאף על פי שהטועה ואומר "מוריד הטל" כמנהגו בקיץ, אינו חוזר ומתפלל שוב את תפלת העמידה כמו שביארנו, מכל מקום כתבו המקובלים שיש בדבר חסרון גדול בתפלה. “The Blessing of the Years”

Our Sages enacted that one must request dew and rain from Hashem during the rainy season in the “Blessing of the Years” found in the Amida prayer (ninth blessing of the Amida). In Israel, we begin requesting rain from the night of the Seventh of Marcheshvan. This year (5772), the night of the Seventh of Marcheshvan falls out on this coming Thursday night, i.e. during the Arvit prayer of this coming Thursday night, one should begin reciting “Barech Alenu” and “Ve’Ten Tal U’Matar Livracha.” “The Blessing of the Years” is a blessing which includes mankind’s collective need to be showered with abundance from Heaven. Included in this blessing is a prayer for one’s livelihood and that blessing rest in all that we do.

The Reason We do not Request Rain Beginning from Simchat Torah
Although it seems that we should have begun requesting rain immediately following the holiday of Sukkot since we enter the season worthy of rainfall at that point (it is for this reason that we indeed begin reciting the “Powers of Rain,” i.e. “Mashiv Ha’Ruach U’Morid Ha’Geshem” from the Mussaf prayer of Simchat Torah [Shemini Atzeret outside of Israel]), nevertheless, our Sages enacted that one should not request rain in the “Blessing of the Years” until the night of the Seventh of Marcheshvan, for the entire Jewish nation would make a pilgrimage to the Bet Hamikdash during the Sukkot holiday and would then head home; since it took certain people until the Seventh of Marcheshvan to arrive home, in order for those making the pilgrimage not to be harmed by the rain, our Sages established to abstain from asking for rain until the Seventh of Marcheshvan.

“The Blessing of the Years” Outside of Israel
Outside of Israel, we begin requesting dew and rain in the “Blessing of the Years” beginning from the Arvit prayer of the Fourth of December. In a year during which February has twenty-nine days (such as this coming year), we begin asking for dew and rain beginning from the Arvit prayer of the Fifth of December. This is indeed the custom in Europe and in the United States.

In countries where the climate is the opposite of Israel and Europe, i.e. their summer is between Sukkot and Pesach, they do not request dew and rain in the “Blessing of the Years” and they do not mention “Mashiv Ha’Ruach U’Morid Ha’Geshem” in the “Ata Gibor” blessing of the Amida. During their winter, they should request dew and rain within the “Shema Koleinu” blessing of the Amida.

In countries with seasons opposite of those in Israel, such as Argentina and Brazil, the Halacha for such countries follows the ruling prescribed by the Sefer Halacha Berura that they have the same law as those in the United States and must request dew and rain from the Fourth or Fifth of December. This is indeed the opinion of the consensus of great Poskim.

Taking Care not To Err While Reciting the “Blessing of the Years” or “Mashiv Ha’Ruach
One should take care not to continue his recitation of the “Blessing of the Years” during the winter months as he has during the summer months, for besides for resulting in the prohibition of reciting blessings in vain, this also shows an overall levity towards one’s prayer, as he shows that he is not even paying attention to the words emerging from his mouth. The same applies to the recitation of “Mashiv Ha’Ruach U’Morid Ha’Geshem,” for although we have already established that if one mistakenly said “Morid Ha’Tal” instead of “Mashiv Ha’Ruach” as he was accustomed to during the summer months, he does not repeat the Amida prayer, nevertheless, the Mekubalim write that this causes a great deficiency in one’s prayer. (See Chemdat Yamim, Shemini Atzeret, for more on this matter.) With some minor attentiveness, one can prevent all of these errors

דין מי ששכח להזכיר ותן טל ומטר בברכת השנים


בהלכה הקודמת

ביארנו באופן כללי את עיקר הדין שתיקנו רבותינו שהחל מליל שבעה במרחשוון מבקשים בתפילה בברכת השנים "ותן טל ומטר לברכה". ועל כל אדם להזהר בתפילתו שלא ישכח להזכיר את בקשת הגשמים בתפילה. ועתה נבאר הדין במי ששכח לבקש בתפילתו על הגשם.

בגמרא במסכת ברכות (כט.) אמרו, טעה ולא שאל גשמים בברכת השנים, מחזירין אותו. כלומר, אם טעה אדם ולא הזכיר בקשה על הגשמים בברכת השנים, דינו כדין מי שחיסר ברכה אחת מברכות התפילה, שאין תפילתו תפילה, ועליו לחזור ולהתפלל שנית אם סיים תפילתו בלא שאלת גשמים. וכן פסקו הרמב"ם (פ"י מהלכות תפילה) ומרן השלחן ערוך (סימן קיז).

אולם אם נזכר ששכח לבקש על הגשמים לפני שסיים את ברכת השנים, כלומר שעדיין לא בירך "מברך השנים", יחזור לתחילת ברכת השנים ויתקן לומר את הנוסח שאנו אומרים בחורף. ואם התחיל כבר בחתימת ברכת השנים, כלומר שאמר, "כי אל טוב ומטיב אתה ומברך השנים ברוך אתה ה’", ונזכר שלא ביקש על הגשמים, לא יוכל לחזור מיד לתחילת הברכה, שאז נמצא שהזכיר שם ה’ לשוא. ולכן יאמר "למדני חוקיך", (שאז הזכרת ה’ אינה לשוא, שהרי פסוק הוא בתהלים "ברוך אתה ה’ למדני חקיך"), ויחזור לתחילת הברכה, ברך עלינו וכו’ (או "ברכנו" למנהג האשכנזים), ויבקש על הגשמים.

ואם נזכר אחר שסיים כבר את ברכת השנים, אבל עדיין לא התחיל בברכת "תקע בשופר גדול", יזכיר מיד "ותן טל ומטר לברכה" וימשיך בתפילתו. (וטוב שבברכת שמע קולינו יחזור ויאמר, ותן טל ומטר לברכה "על כל פני האדמה").

ואם סיים את ברכת השנים ונזכר שלא שאל טל ומטר, מבואר בגמרא, שאם נזכר לפני שהגיע לברכת "שומע תפילה", גם כן אינו חוזר להתפלל מראש התפילה, מפני שיכול לבקש על הגשמים בברכת שמע קולינו שהיא כוללת את כל הבקשות בתפילה, ובכך יתקן את מה שהחסיר בתפילתו. והכוונה בזה, שבברכת שומע תפילה, לפני שיאמר "כי אתה שומע תפילת כל פה" וכו’, יאמר, "ותן טל ומטר לברכה על כל פני האדמה", ובכך הוא מבקש על הגשמים. ואם נזכר שלא שאל טל ומטר אחרי שהתחיל כבר בחתימת ברכת שומע תפילה, כלומר שאמר, כי אתה שומע תפילת כל פה ברוך אתה ה’", יסיים מיד "למדני חוקיך", ויחזור לתחילת ברכת שומע תפילה, ויבקש בברכתו על הגשמים.

ואם נזכר אחר שסיים את ברכת שומע תפילה לגמרי, אבל לא התחיל עדיין לומר "רצה ה’ אלהינו בעמך ישראל", יאמר מיד "ותן טל ומטר לברכה", ואחר כך ימשיך בברכת "רצה".

ואם התחיל כבר בברכת "רצה", וכן אם נזכר באחת הברכות שלאחר מכן, או אפילו באמצע "אלוקי נצור", כל שעדיין לא אמר "יהיו לרצון" האחרון שלאחר אלוקי נצור, חוזר לברכת השנים, ושואל שם טל ומטר וממשיך בתפילתו משם על סדר הברכות.

אבל אם נזכר אחרי שסיים את אמירת יהיו לרצון שאחרי אלוקי נצור, שוב אין לו תקנה, ועליו לחזור לראש התפילה ולהתפלל שנית.

ולסיכום: מי ששכח לבקש על הגשמים בברכת השנים, אם נזכר באמצע ברכת השנים, יחזור לתחילת הברכה ויבקש על הגשמים. ואם נזכר לאחר שהתחיל בחתימת הברכה "ברוך אתה ה’", יסיים "למדני חוקיך", ויחזור לתחילת ברכת השנים. ואם נזכר לאחר שסיים את ברכת השנים לגמרי, אבל לא התחיל עדיין בברכת "תקע בשופר גדול", אז יזכיר מיד "ותן טל ומטר לברכה", וימשיך בברכת תקע בשופר גדול.

ואם נזכר לאחר שהתחיל בברכת תקע בשופר גדול, יבקש על הגשמים בברכת שמע קולינו, שלפני שיאמר "כי אתה שומע תפילת כל פה", יאמר, "ותן טל ומטר לברכה על כל פני האדמה". ואם נזכר בסיום ברכת שומע תפילה לאחר שאמר "ברוך אתה ה’", אז יאמר "למדני חוקיך", ויחזור לתחילת ברכת שומע תפילה ויבקש על הגשמים. ואם סיים את ברכת שומע תפילה, אבל לא התחיל עדיין באמירת "רצה", יזכיר שם "ותן טל ומטר לברכה" וימשיך בברכת רצה.

ואם נזכר לאחר שהתחיל בברכת רצה, חוזר לברכת השנים, ומבקש שם על הגשמים וממשיך על סדר הברכות משם. ואם נזכר אחר שסיים את אמירת "יהיו לרצון" שבסיום אמירת "אלקי נצור", יחזור לראש התפילה ויתפלל שנית

The Laws of One Who Forgets to Mention “Ve’Ten Tal U’Matar” in the “Blessing of the Years”

In the previous Halacha, we have discussed in a general manner that our Sages enacted that beginning from the Seventh of Marcheshvan (outside of Israel from the Fourth or Fifth of December), one begins reciting “Ve’Ten Tal U’Matar” (a request for dew and rain) in the “Blessing of the Years” within the Amida prayer. One should take care not to forget to mention the request for rain in his prayer. We shall now discuss the laws of one who has forgotten to request rain in his prayer.

The Gemara in Masechet Berachot (29a) states: “If one errs and forgets to request rain in the ‘Blessing of the Years,’ we require him to go back.” This means that if one mistakenly omits the request for rain in the “Blessing of the Years,” it is considered as if he has omitted an entire blessing from the Amida prayer, in which case his prayer is not considered a prayer, and if he has concluded his entire prayer without asking for rain, he must repeat the entire Amida. The Rambam (Hilchot Tefillah, Chapter 10) and Maran HaShulchan Aruch (Chapter 117) rule likewise.

Nevertheless, if one remembers that he has forgotten to request rain before concluding the “Blessing of the Years,” i.e. before reciting the last words in the blessing, “Mevarech Ha’Shanim,” he should go back to the beginning of the “Blessing of the Years” and recite the text we customarily use during the winter months. If one has already begun the conclusion of the blessing by saying “Ki Kel Tov U’Metiv Ata Umvarech Ha’Shanim, Baruch Ata Hashem,” and only then remembers that he has forgotten to request rain, he cannot immediately revert back to the beginning of the blessing, for this would cause him to have recited Hashem’s name in vain; rather, one should recite the words “Lamedeni Chukecha” (in which case his mentioning of Hashem’s name will not have been in vain, for there is a verse in Tehillim, “Baruch Ata Hashem Lamedeni Chukecha”), after which one should go back to the beginning of the blessing, i.e. Barech Alenu, and request rain.

If one remembers after he has already concluded the “Blessing of the Years” but before beginning the next blessing of “Teka Be’Shofar Gadol,” he may insert “Ve’Ten Tal U’Matar Livracha” right there and he may then continue his prayer as usual. (It is preferable that he once again mention “Ve’Ten Tal U’Matar Al Kol Peneh Ha’adama” within the “Shema Kolenu” blessing of the Amida.)

If one has concluded the “Blessing of the Years” and then remembers that he has forgotten to request dew and rain, the Gemara explains that if he remembers this before reciting the “Shema Kolenu” blessing of the Amida, one does not go back and begin praying anew since he can request rain in the “Shema Kolenu” blessing which includes all requests of the prayer; by doing so, one can supplement what he has previously left out of his prayer. This means that during the “Shema Kolenu” blessing, before reciting “Ki Ata Shome’a Tefillat Kol Peh,” one should recite “Ve’Ten Tal U’Matar Livracha Al Kol Peneh Ha’adama,” and by doing so, one will have requested rain. If one remembers that he has not requested dew and rain only once he has already begun concluding the “Shema Kolenu” blessing by saying “Baruch Ata Hashem,” he should immediately insert the words “Lamedeni Chukecha” and go back to the beginning of the “Shema Kolenu” blessing and then insert his request for rain.

If one only remembers after completing the “Shema Kolenu” blessing but has not yet begun saying “Retzeh Hashem Elokeinu Be’Amecha Yisrael,” one should insert “Ve’Ten Tal U’Matar Livracha,” and may then continue the “Retzeh” blessing as usual.

If, however, one has already begun saying “Retzeh” and only then remembers or if one remembers at any subsequent point in the Amida prayer, even in the middle of “Elokai Netzor” for that matter, as long as he has not yet recited the last “Yihyu Le’Ratzon” following “Elokai Netzor,” one must go back to the “Blessing of the Years” and ask for dew and rain there and subsequently continue all the other blessings as usual, in their order.

However, if one only remembers after reciting the “Yihyu Le’Ratzon” following “Elokai Netzor,” he no longer has any recourse but to go back to the beginning of the Amida prayer and pray again.

Summary: If one has forgotten to request rain in the “Blessing of the Years,” but remembers within the “Blessing of the Years,” he should go back to the beginning of the blessing and request rain. If one only remembers after beginning the blessing’s conclusion of “Baruch Ata Hashem,” he should insert the words “Lamedeni Chukecha” and then go back to the beginning of the “Blessing of the Years.” If one remembers only after concluding the blessing entirely but before beginning the “Teka Be’Shofar Gadol” blessing, he may insert “Ve’Ten Tal U’Matar” right there and then proceed with the “Teka Be’Shofar Gadol” blessing.

If one only remembers after starting the “Teka Be’Shofar Gadol” blessing, he should request rain within the “Shema Kolenu” blessing by inserting “Ve’Ten Tal U’Matar Livracha Al Kol Peneh Ha’adama” before saying “Ki Ata Shome’a Tefillat Kol Peh.” If one remembers only after beginning the conclusion of this blessing, i.e. after saying “Baruch Ata Hashem,” he should insert the words “Lamedeni Chukecha” and then go back to the beginning of the “Shema Kolenu” blessing and request rain. If one remembers only after concluding the “Shome’a Tefillah” blessing but has not yet begun reciting “Retzeh,” he may insert “Ve’Ten Tal U’Matar Livracha,” after which he may continue reciting “Retzeh” as usual.

If one remembers only after beginning the “Retzeh” blessing, one must go back to the “Blessing of the Years” and request dew and rain there and then continue reciting the rest of the blessings of the Amida as usual. If one remembers only after reciting the final “Yihyu Le’Ratzon” following “Elokai Netzor,” one must go back to the beginning of the Amida prayer and pray once again

The Laws of One Who Forgets to Mention “Ve’Ten Tal U’Matar” in the “Blessing of the Years”

One who Forgets to Request Rain Must Repeat the Amida Prayer

(It is preferable that he once again mention “Ve’Ten Tal U’Matar Al Kol Peneh Ha’adama” within the “Shema Kolenu” blessing of the Amida.)

If one has concluded the “Blessing of the Years” and then remembers that he has forgotten to request dew and rain, the Gemara explains that if he remembers this before reciting the “Shema Kolenu” blessing of the Amida, one does not go back and begin praying anew since he can request rain in the “Shema Kolenu” blessing which includes all requests of the prayer; by doing so, one can supplement what he has previously left out of his prayer. This means that during the “Shema Kolenu” blessing, before reciting “Ki Ata Shome’a Tefillat Kol Peh,” one should recite “Ve’Ten Tal U’Matar Livracha Al Kol Peneh Ha’adama,” and by doing so, one will have requested rain. If one remembers that he has not requested dew and rain only once he has already begun concluding the “Shema Kolenu” blessing by saying “Baruch Ata Hashem,” he should immediately insert the words “Lamedeni Chukecha” and go back to the beginning of the “Shema Kolenu” blessing and then insert his request for rain.

If one only remembers after completing the “Shema Kolenu” blessing but has not yet begun saying “Retzeh Hashem Elokeinu Be’Amecha Yisrael,” one should insert “Ve’Ten Tal U’Matar Livracha,” and may then continue the “Retzeh” blessing as usual.

If, however, one has already begun saying “Retzeh” and only then remembers or if one remembers at any subsequent point in the Amida prayer, even in the middle of “Elokai Netzor” for that matter, as long as he has not yet recited the last “Yihyu Le’Ratzon” following “Elokai Netzor,” one must go back to the “Blessing of the Years” and ask for dew and rain there and subsequently continue all the other blessings as usual, in their order.

However, if one only remembers after reciting the “Yihyu Le’Ratzon” following “Elokai Netzor,” he no longer has any recourse but to go back to the beginning of the Amida prayer and pray again.

Summary: If one has forgotten to request rain in the “Blessing of the Years”:

  • If one remembers in the middle of the Blessing of the Years, he should return to the beginning of the blessing and recite the appropriate text for the winter months.
  • If one remembers after he says the words, “Ki El Tov U’Metiv Ata Umvarech Ha’Shanim Baruch Ata Hashem,” one should say the words “Lamedeni Chukecha” and return to the beginning of the blessing and recite it correctly.
  • If one remembers after concluding the blessing by saying “Baruch Ata Hashem Mevarech Ha’Shanim” but has not yet begun the “Teka Be’Shofar Gadol” blessing, one should insert the words “Ve’Ten Tal U’Matar Livracha Al Kol Peneh Ha’adama” right there and then proceed with the “Teka Be’Shofar Gadol” blessing.
  • If one remembers only after he has begun the “Teka Be’Shofar Gadol” blessing, one should insert the words “Ve’Ten Tal U’Matar Livracha Al Kol Peneh Ha’adama” in the “Shema Kolenu” blessing before the words “Ki Ata Shome’a Tefillat Kol Peh.”
  • If one remembers during the “Shema Kolenu” blessing after reciting the words “Ki Ata Shome’a Tefillat Kol Peh Baruch Ata Hashem,” one should recite the words “Lamedeni Chukecha,” return to the beginning of the “Shema Kolenu” blessing, and insert “Ve’Ten Tal U’Matar Livracha.”
  • If one remembers only after he has completed the “Shema Kolenu” blessing but has not yet begun the “Retzeh” blessing, one should insert “Ve’Ten Tal U’Matar” right there and then proceed with the “Retzeh” blessing.
  • If one remembers after beginning the “Retzeh” blessing, one must return to the “Blessing of the Years”, recite the correct version, and continue with the rest of the blessings of the Amida (“Teka Be’Shofar Gadol”, “Hashiva Shofetenu”, etc.) once again.
  • If one remembers only after reciting the “Yihyu Le’Ratzon” verse after the “Elokai Netzor” prayer, one must return to the beginning of the Amida and pray again, this time concentrating and requesting rain in accordance with the law.

דין המסופק אם שאל טל ומטר בתפילתו

בהלכות הקודמות, ביארנו את דין שאלת (בקשת) טל ומטר בברכת השנים, (שהתחלנו בהזכרתה בתפלת ערבית האחרונה, אתמול בערב), והזכרנו שמי שסיים את תפילתו ונזכר שלא שאל טל ומטר, עליו לחזור ולהתפלל שנית, שהרי זה כמי שהחסיר ברכה אחת מתפילתו, שדינו הוא כמי שלא התפלל כלל. ועתה נבאר מהו דין מי שסיים את תפילתו, וכעת עלה ספק בלבו אם הזכיר בתפילתו שאלת טל ומטר אם לאו.

דברי רבותינו בענין רגילות הלשון
מדברי רבותינו בתלמוד ירושלמי (בתחילת מסכת תענית) למדנו, שכל מי שהוא מסופק אם ביקש גשמים בתפילתו, הדין הוא שעד שלשים יום הרי הוא בחזקת שלא התפלל כפי שצריך, ועליו לחזור ולהתפלל שנית. וביאור הדברים, שעד שלושים יום מתאריך השינוי בתפילה, (כלומר, מתאריך ז’ בחשוון, במשך שלושים יום), חזקה על האדם שלשונו המשיכה בתפילה כפי שהיא מורגלת, ומכיון שהיא רגילה שלא לבקש על הגשמים, לכן במקום ספק, יש לנו לתלות יותר שלא הזכיר בתפילה את בקשת הגשמים, ולפיכך עליו לחזור ולהתפלל שנית. וכן פסקו הפוסקים ומרן השלחן ערוך (סימן קיד).

והנה עיקר דין זה שהבאנו בשם הירושלמי, נזכר לענין הזכרת "משיב הרוח" בברכת אתה גיבור, ולא לענין שאלת גשמים ברכת השנים. אולם מכיון שאין חילוק בדבר, כתבו האחרונים שהוא הדין אף לגבי שאלת גשמים בברכת השנים.

האם הדבר תלוי ב"שלושים יום" או ב"תשעים פעם"?
ומכל מקום נחלקו רבותינו האחרונים בעיקר דין זה, אם הכוונה היא שלאחר שלושים יום הלשון מתרגלת לשינוי שחל בתפילה, או שהכוונה בזה היא, שלאחר תשעים תפילות (שהרי יש לנו שלוש תפילות בכל יום) מתרגלת הלשון לשינוי בתפילה.

ויש לדבר זה משמעות רחבה למעשה, שהרי ברכת השנים אינה נזכרת בתפילה תשעים פעם בשלושים יום, שהרי בשבתות אין אנו מבקשים כלל על הגשמים. ואם כן יש לדון מה יעשה אדם המסופק אם ביקש בתפילה על הגשמים, ועברו שלושים יום מתאריך השינוי בתפילה, אך עוד לא עברו תשעים תפילות עם שינוי זה. האם יחזור להתפלל, או לא? וכמו כן יש לדון במקום שעברו שלושים יום מתאריך השינוי בתפילה, אך אותו אדם החסיר מאיזו סיבה כמה תפילות בתוך השלושים יום. האם יחזור מספק שכן לא התפלל תשעים פעם את אותה התפילה, או שלא יחזור הואיל ועברו שלושים יום?

ולמעשה, מכיון שהדבר שנוי במחלוקת הפוסקים, הנכון הוא שאם אירע שהסתפק אדם אם הזכיר בתפילתו שאלת טל ומטר, והיה זה בימים הסמוכים לשלשים יום אחר ז’ חשוון, כשעדיין לא עברו תשעים תפילות עם שאלת טל ומטר, טוב שיחזור להתפלל שנית, אך יעשה "תנאי נדבה" לפני שיתחיל בתפילה. דהיינו שיאמר "הריני חוזר ומתפלל שנית אם אני חייב לחזור, ואם איני חייב לחזור ולהתפלל, הרי תפילה זו תהיה תפילת נדבה". ובזה הוא יוצא מכל ספק. כן העלה להלכה בספר הלכה ברורה (סימן קיד סעיף יד).

ולסיכום: המסופק אם שאל בתפילתו טל ומטר, אם היה זה תוך שלושים יום מתאריך השינוי בתפילה, יחזור ויתפלל, שמן הסתם לא שאל טל ומטר. ואם היה זה אחר שעברו יותר משלושים יום, וכבר עברו עליו תשעים תפילות עם הזכרת טל ומטר, אינו חוזר, שמן הסתם הורגלה לשונו לשינוי שחל בתפילה. ואם היה זה אחר שלושים יום, אבל לא עברו עדיין תשעים תפילות עם שאלת גשמים, אז הדין הוא שיחזור להתפלל על תנאי נדבה, וכמבואר.

If One is Uncertain Whether or Not he has Requested Rain in his Prayer

In the previous Halachot we have discussed the basic Halachot of requesting dew and rain in the “Blessing of the Years.” We have likewise mentioned that if one has completed the Amida prayer and remembers that he has not requested rain, he must repeat the entire Amida prayer, for he is considered to have omitted a blessing from the Amida and thus not prayed at all. We shall now discuss the law regarding one who has completed the Amida and is unsure whether or not he requested rain in his prayer.

The Words of our Sages Regarding the “Routine of the Tongue”
Our Sages in the Talmud Yerushalmi (beginning of Masechet Ta’anit) teach us that when one is unsure whether or not he has requested rain in his prayer, until thirty days have passed, we must assume that he has not prayed properly. This means that until thirty days elapse from the day the change is implemented in the Amida prayer (the 7th of Cheshvan in Israel or the 4th/5th of December outside of Israel), we must assume that one prayed based on the “routine of his tongue,” i.e. the way he is accustomed to. Since one has not been accustomed to request rain in the prayer during the summer months, when in doubt, we must assume that he has indeed not done so and must repeat the Amida prayer again. The Poskim, as well Maran Ha’Shulchan Aruch (Chapter 114), rule likewise.

Indeed, this law quoted from the Yerushalmi is primarily cited with regards to mentioning “Mashiv Ha’Ruach” in “Ata Gibor” and not with regards to requesting rain in the “Blessing of the Years.” Nevertheless, the Poskim write that since there is no distinction between them, the same law applies to the requesting rain in the “Blessing of the Years.”

Does this Law Depend on “Thirty Days” or “Ninety Prayers”?
There is a disagreement among the Acharonim regarding the meaning of this law. Does it mean that after thirty days, one’s tongue becomes accustomed to the variation in the text of the prayer or does it mean that one becomes accustomed after ninety prayers (for there are three prayers a day). There is indeed a great halachic implication here, for the “Blessing of the Years” is not recited in the Amida prayer ninety times in thirty days, for rain is not mentioned on Shabbat at all. Based on this, we must discern the law of a person who is unsure whether or not he has requested rain in the Amida prayer at a time during which thirty days have elapsed from when the change was implemented but ninety prayers have not yet been recited. Must he repeat the Amida prayer or not? Similarly, if thirty days have elapsed since the change in the prayer has been implemented, but for whatever reason, the individual has not recited all of the prayers during the thirty days. Shall he repeat the Amida as a result of his doubt, for he has not recited all ninety prayers, or should he not repeat the prayer since thirty days have elapsed?

Halachically speaking, since this matter is subject to a disagreement among the Poskim, if an individual is unsure whether or not he has requested rain in the Amida prayer close to the 7th of Cheshvan (or the 4th/5th of December outside of Israel), it is proper to repeat the Amida prayer. Nevertheless, before beginning to pray, one should stipulate and say as follows: “If I am obligated to repeat the Amida, I am hereby repeating it. If I am not obligated to do so, this prayer should be considered a voluntary prayer.” By doing so, one avoids all concerns. The Sefer Halacha Berura (Chapter 114, Section 14) rules likewise.

Summary: If one is unsure whether or not he has requested rain in the Amida prayer, if this occurs within thirty days of the initial change in the prayer, one must repeat the Amida prayer, for we must assume that he did not request rain. If this occurs once thirty days have elapse and one has already recited ninety prayers including a request for rain, one need not repeat the Amida prayer, for we can assume that he has already become accustomed to saying the change that has been implemented in the prayer. If this occurs once thirty days have elapsed but one has not yet recited ninety prayers including a request for rain, one must repeat the Amida prayer and make the aforementioned condition.

Halachot from Maran Rabbi Ovadia Yosef Ztz’l

שאלה: האם יש לענות אמן אחר ברכותיהם של ילדים קטנים?

תשובה: בבריתא במסכת ברכות (דף נג.) שנינו: אחרי כל מי שמברך עונים אמן, חוץ מאחרי תינוקות של בית רבן. והני מילי (ואלו הדברים, כלומר וכך הדין) בעידנא דגמרי, כלומר בזמן שלומדים סדר הברכות בפני רבן (רב שלהם) אבל בעידנא דמפטרי נפשייהו, עונין. כלומר בזמן שהם מתברכים בכדי לפטור את עצמם, עונים אמן אחר ברכותיהם.

וביאור הדבר הוא, כמו שכתב מרן השלחן ערוך (סימן רטו) שמותר ללמד לתינוקות את הברכות כתקנן, ואף על פי שהם מברכין לבטלה בשעת הלימוד, שהרי בזמן שמלמדים ילד קטן לברך, מלמדים אותו נוסח הברכה אף בלא שיתחייב בה. וכגון הרוצה לחנך את בנו לברך ברכת בורא פרי העץ, רשאי לבקשו לברך כמה פעמים על פרי אחד, אף שמן הדין אין לברך אלא פעם אחת. ולכן אין לענות "אמן" אחר ברכות כאלה, שהרי לא שייך לומר אמן לאמת ולקיים את דברי המברך בזמן שברכתו אינה ברכה.

אבל בזמן שהם מברכים כדין כדי לפטור את עצמם, כיון שממצות חינוך הם מברכים אף לפני הגיעם לגיל מצוות, לכן יש לענות אחר ברכתם אמן.

אולם כתבו האחרונים שכל זה דוקא בקטנים שכבר הגיעו לגיל חינוך, שיודעים כבר ענין הברכה ומבינים למי הם מברכים, אבל תינוקות וילדים קטנים ממש אין לענות אמן אחר ברכותיהם, לפי שיש לחוש שאין גופם נקי כראוי, ולכן מה שפסקו הטור ומרן השלחן ערוך שיש לענות אמן אחרי ברכת קטנים שהם מברכין לפטור את עצמן כיון שהם בני חינוך, כוונתם היא דוקא בילדים שהגיעו כבר לגיל חינוך. ומרן הרב עובדיה יוסף שליט"א כתב, שמספק אין לענות אמן אלא על ברכה של ילד שהגיע לגיל תשע ואילך.

ומכאן נלמד, שיש לחנך את הילדים לנקות את גופם היטב היטב, שאם אינם מנקים עצמם כראוי לאחר שעושים את צרכיהם, הרי שכל ברכותיהם ותפלותיהם הולכים לשוא

Question: May one answer “Amen” to a blessing recited by a young child?

Answer: The Baraita in Masechet Berachot (53b) states, “One answers ‘Amen’ to a blessing recited by anyone except for young children. However, this only applies when they are learning how to recite the blessing with their Rebbi, but if they are reciting the blessing in order to exempt themselves, ‘Amen’ is answered to their blessings.”

Maran HaShulchan Aruch (Chapter 215) explains this to mean that it is permissible to teach children the proper way to recite a blessing even though one is reciting a blessing in vain, for when one teaches a young child to bless, this is done even when the child has not done anything (or eaten anything) to require a blessing. For instance, if one wishes to educate his child to recite the “Boreh Peri Ha’etz” blessing, one may ask him to recite the blessing several times on the same fruit although halachically, he should only be reciting the blessing once. One should therefore not answer “Amen” after such blessings, for one cannot say “Amen” which is in essence verifying and affirming the words of the one blessing when the blessing is not a blessing at all.

However, if they are reciting a blessing to exempt themselves (i.e. they are actually performing an action which requires the recitation of a blessing), since they are obligated to recite blessings before the age of Bar/Bat Mitzvah based on the Mitzvah of educating them, one indeed answers “Amen” to their blessing.

Nevertheless, the Acharonim point out that this applies only to children who have reached the age of education which is when they understand the idea of blessings and know to Whom they are blessing; however, one should not answer “Amen” to the blessings of toddlers and very young children, for we must be concerned that their body is not properly clean. Thus, when the Tur and Maran HaShulchan Aruch write that one should answer “Amen” to the blessings of children when they are reciting the blessing in order to exempt themselves, this refers only to children who have reached the age of education. Maran Harav Ovadia Yosef Shlit”a writes that because this age is doubtful, one should answer “Amen” only when the child is nine years of age and older.

Based on this, one should educate his children to clean their body very well, for if they do not clean themselves well after using the facilities, all of their blessings and prayers will have been in vain

שאלה: האם נכון הדבר שאסור לנשים לעשות מלאכה בראש חודש?

תשובה: אמרו רבותינו בפרקי דרבי אליעזר, שבזמן חטא העגל, אמר אהרן לכל עדת ישראל "פרקו נזמי הזהב אשר באזני נשיכם בניכם ובנותיכם" כדי להתיך את כל הזהב ולעשות ממנו את עגל הזהב. וכששמעו על כך הנשים, לא רצו לתת נזמיהן לבעליהן, ואמרו להם, אתם רוצים לעשות פסל ומסכה תועבת ה’ שאין בו כוח להציל, לא נשמע לכם! ונתן להן הקדוש ברוך הוא שכרן בעולם הזה, שהן משמרות ראשי חודשים יותר מן האנשים, ושכרן לעולם הבא שהן עתידות להתחדש כנשר נעוריהן, כמו המולד של ראשי חדשים. ולפיכך נהגו הנשים שלא לעשות מלאכה בראש חודש. ונאמרו אודות מנהג זה עוד כמה טעמים. והטור הוסיף טעם בשם אחיו רבי יהודה (בעל שו"ת זיכרון יהודה) לפי שהמועדים נתקנו כנגד האבות (שהרי ישנם שלושה מועדים מן התורה, פסח, סוכות ושבועות) ושנים עשר ראשי חדשים נתקנו כנגד שנים עשר השבטים, וכשחטאו ישראל בחטא העגל ניטלו (נלקחו) מהם וניתנו לנשותיהם, לזכר שלא היו באותו החטא.

אולם כתב מרן הרב עובדיה יוסף זצ"ל, שלא נהגו הנשים לאסור עליהן כל מלאכה, אלא רק מלאכות טויה (של חוטים, שהיא מלאכה קשה שהיו נוהגות הנשים לעשותה) וכדומה, וכן כתב הגאון יעב"ץ בספרו מור וקציעה, שמלאכות קלות ממלאכת הנשים ודאי מותרות לעשותן בראש חודש, ולפיכך מותרות גם לכבס במכונת כביסה שאין בה טורח כל כך, ומותרות לסרוג ולתפור לצורך בני ביתן, אבל לא לצורך קבלת שכר מאנשים אחרים. והעובדות והעוסקות במלאכתן לצורך פרנסתן, שאם לא יעבדו בראש חודש יפסידו פרנסתן, מותר להן לעבוד בראש חודש.

בימי הראשונים, היו גם אנשים רבים, שנמנעו מעשיית מלאכה בימי ראש חודש, מכמה טעמים, ולפיכך כתב מרן החיד"א, שאדם הרוצה להחמיר שלא לעשות מלאכה בראש חודש, יחשב לו הדבר לצדקה (כלומר, לזכות מיוחדת) וכתב עוד מרן הרב זצ"ל, שהנוהג שלא לעשות מלאכה בראש חודש, ומקדיש את אותו היום לתורה, אשריו ואשרי חלקו, (ואם רוצה לבטל מנהגו צריך לעשות "התרת נדרים" אם לא אמר שעושה כן "בלי נדר".)

Question: Is it correct that women may not perform work on Rosh Chodesh?

Answer: Our Sages teach us in Pirkei De’Rabbi Eliezer that during the sin of the Golden Calf, Aharon told the entire Jewish nation, “Remove the golden rings from the ears of your wives, sons, and daughters” in order to melt down this gold and use it to form the Golden Calf. When the women heard this, they refused to give their golden jewelry to their husbands and told them, “We shall not allow you to form an idol repulsive to Hashem which cannot save you at all!” Hashem rewarded them in this world by having them observe Rosh Chodesh more than men. Their reward in the World to Come is that their youthfulness shall be rejuvenated like an eagle similar to the “rebirth” of the moon on Rosh Chodesh. It is therefore customary for women not to perform work on Rosh Chodesh. There are several other reasons offered for this custom. The Tur adds in the name of his brother, Rabbeinu Yehuda (author of Responsa Zichron Yehuda), that the festivals correspond to our Patriarchs (as there are three festivals in the Torah: Pesach, Shavuot, and Sukkot) and the twelve Rashei Chodashim correspond to the twelve tribes. When the Jewish nation sinned in the incident regarding the Golden Calf, Rosh Chodesh was taken away from the men and given to the Jewish women as a commemoration that they were not involved in this sin.

Nevertheless, Maran Rabbeinu Ovadia Yosefzt”l writes that women did not customarily prohibit themselves from performing any kind of work and this only applies to spinning and weaving (threads, which is an intricate and difficult craft) and the like. Indeed, Hagaon Ya’abetz writes in his Sefer Mor Uktzia that any works that are lighter and easier than women’s crafts are certainly permissible on Rosh Chodesh. It is therefore permissible for women to launder clothing in a washing machine, for this is not such a hassle. They are likewise permitted to knit and sew when this is necessary for the members of their household; however, they should not do so for others in order to earn a profit. Those women who work in order to earn a living and will lose money by not working on Rosh Chodesh may indeed work on Rosh Chodesh.

In the times of the Rishonim, there were also many men who abstained from performing work on Rosh Chodesh for several reasons. It is for this reason that Maran Ha’Chida writes that a man who wishes to act stringently and abstain from performing work on Rosh Chodesh is considered especially meritorious. Maran Haravzt”l adds that if a man abstains from performing work on Rosh Chodesh and dedicates the entire day to Torah study is indeed very praiseworthy. (If one wishes to annul this custom and did not say “Bli Neder” before beginning to observe it, one must perform the order of “Annulment of Vows.”)

איסור אכילה קודם שיתן מאכל לבהמתו

בגמרא במסכת ברכות (מ.) אמר רב יהודה אמר רב, אסור לאדם שיאכל קודם שיתן לבהמתו לאכול, שנאמר (דברים יא) "ונתתי עשב בשדך לבהמתך, ואכלת ושבעת". ומבואר אם כן, שמכיון שהקדימה התורה את הבהמה לאדם לענין האכילה (להיפך ממה שהיה ראוי יותר להקדים את האדם לבהמה), לכן אסור לאדם לאכול לפני שיתן מאכל לבהמתו. וכן פסקי הרמב"ם וכל הפוסקים. ומובן שאין חילוק בזה בין בהמה לחיה ועוף, שלכולם חייב לתת מאכל לפני שיאכל הוא. ועל כן המגדל בביתו בעל חי ורוצה לאכול איזה דבר, עליו לתת קודם מאכל לאותו בעל חי ואחר כך רשאי לאכול.

ולענין טעימת מאכל בלבד לפני נתינת מאכל לבהמות, כתב הטורי זהב ( סי’ קסז ס"ק ז) שבטעימה בלבד אין איסור, וכלשון הגמרא, אסור "לאכול" עד שיתן מאכל לבהמתו, משמע שבטעימה בלבד אין איסור.

אולם מרן החיד"א בברכי יוסף (ס"ק ה) תמה על דברי הטורי זהב, שהרי גירסת הרי"ף והרא"ש בגמרא, אסור "לטעום", וכן גורסים עוד רבים מן הראשונים, ואם כן משמע שאף בטעימה בלבד יש לאסור. ובאמת שכך היא גרסת הגמרא בגיטין (סב.) שאסור אף לטעום קודם שיתן מאכל לבהמתו. ולכן גם בטעימה בלבד יש לאסור. וכן פסק מרן הרב שליט"א בספר הליכות עולם (עמ’ שנב).

ולענין שתיה קודם נתינת משקה לבהמה, כתב בספר חסידים שלענין שתיה האדם קודם לבהמה, ורשאי לשתות קודם שיתן משקה לבהמתו, שנאמר (במדבר כ) "והשקית את העדה ואת בעירם" (בעירם כלומר בהמתם). וכן נאמר (בבראשית כד) "שתה וגם גמליך אשקה", מה שאין כן באכילה שנאמר, ויתן תבן ומספוא לגמלים" ואחר כך נאמר "ויושם לפניו לאכול".

על כן למעשה, אסור לטעום שום דבר לפני שיתן לבעלי החיים שבאחריותו לאכול, אולם לענין שתיה, רשאי לשתות לפני שיתן שתיה לבהמתו. אולם כל זה דוקא במקום שאין צער לבעלי החיים במניעת המשקה מהם, אבל אם הם מצטערים מחסרון המאכל או המשקה, הרי בלאו הכי מחוייב האחראי עליהם לדאוג לכל מחסורם מדין "צער בעלי חיים" שעונשו חמור מאד.

וכאן המקום להזכיר, שמי שיש לו בעלי חיים תחת אחריותו, צריך להזהר מאד שלא יגרם להם שום צער תחת חזקתו, אם במניעת מאכל ומשקה, ואם מבחינת תנאי הגידול שלהם וכיוצא בזה, כי עון זה הוא חמור מאד, וה’ יתברך רחמיו על כל מעשיו, והוא שומע צעקת אותם בעלי חיים, ועלול לבא מתוך כך עונש קשה על האדם. ומפורסם המעשה מהרב האר"י בענין זה, שאמר לאשה אחת שלא היו לה ילדים, כי סיבת העונש היא מפני שמנעה דרך נוחה לתרנגולים לשתות מים. ועל כן הזהירו כמה גדולים, ומהם בספר פלא יועץ, שאין ראוי לכתחילה להכנס לזה בכלל, ולא כדאי לאדם לגדל בעלי חיים כלל אם אינו יודע כיצד לטפל בהם שלא יגרם להם שום צער, ובעיקר יש להמנע מגידול בעלי חיים המועדים לפורענות כגון אפרוחים וכדומה, שעלולים להצטער בנקל. ובכל מקרה שכבר נכנסו לדבר כזה, יש להזהר מאד באיסור צער בעלי חיים, לטפל בהם בדרך הראויה להם כדת וכדין

The Prohibition to Eat before Feeding One’s Animal

The Gemara in Masechet Berachot (40a) states: “Rav Yehuda said in the name of Rav: One may not eat before feeding his animal as the Torah states (Devarim 11), ‘And I shall give grass in your field for your animals, and you shall eat and be satisfied.’” Since the Torah mentions animals before man within the context of eating (contrary to what would have been more proper, i.e. mentioning man first), it is therefore teaching us that one may not eat before feeding his animal. The Rambam and all other Poskim rule likewise. Clearly, there is no distinction between domesticated animals, undomesticated animals, or birds regarding this law and one must feed all of them before eating himself. Thus, if one has a pet in his home and would like to eat something, he must first feed the pet and only then is he permitted to eat.

Regarding just tasting some food before feeding one’s animal, the Turei Zahav (Chapter 167, Subsection 7) writes that tasting alone is not prohibited, as the Gemara writes that one may not “eat” before feeding his animal; we can infer that tasting is indeed permitted.

Nevertheless, Maran HaChida in his Birkei Yosef (ibid. subsection 5) questions this ruling of the Turei Zahav, for the Rif and Rosh’s version of the Gemara is that one may not “taste”; many other Rishonim have the same text. If so, we can infer that merely tasting alone is also prohibited. Indeed, this is the text of the Gemara in Masechet Gittin (62a) that one may not even taste food before he has fed his animal. Thus, even tasting alone is prohibited. Maran Harav Shlit”a rules likewise in his Halichot Olam (page 352).

Regarding drinking before giving one’s animal to drink, the Sefer Chassidim writes that in this regard, man comes before his animal and he may indeed drink before giving his animal to drink, as the verse (Bamidbar 20) states, “And you shall give the congregation and their animals to drink.” Similarly, the verse (Bereshit 24) states, “Drink and I shall also give your camels to drink,” whereas regarding eating the verse states, “And he gave straw and fodder to the camels” and only then does it say, “And [food] was placed before him to eat.”

Thus, halachically speaking, one may not taste any food before feeding the animals one has in his care; however, regarding drinking, one may, in fact, drink before giving his animals to drink. Nevertheless, this only applies when withholding the drink from them does not cause the animals any suffering, however, if they suffer as a result of the lack of food or drink, their caretaker must supply them with all of their needs in any case due to the law of “suffering of animals,” for which the punishment is quite severe.

We should indeed point out that if one has animals under his care, he must be exceedingly careful not to cause them any suffering either as a result of withholding food and drink from them or with regards to their living conditions and the like, for this is a very grave sin and the merciful Hashem hears the cries of these animals and the result may be a very harsh punishment for their keeper. There is a very famous incident related to this where the holy Ariz”l told a woman who could not conceive that the reason for her punishment was because she made it difficult for her chickens to drink water. For this reason, several luminaries, including the Sefer Peleh Yo’etz, advise that it is preferable not to get involved with this to begin with and it is not worthwhile to raise animals at all if one does not know how to take care of them in a way which will not inflict suffering upon them. This primarily applies to raising certain problematic animals, such as chicks and the like, which are easily made to suffer. In any case, if one has already entered this situation, one must be exceedingly careful regarding the prohibition of causing pain to animals by caring for them in the appropriate way, as prescribed by Halacha

בשולי גויים

שאלה: בביתנו נמצאת עובדת שאינה יהודייה. היא מסייעת בכל עניני הבית, וכן מבשלת עבורינו את האוכל. כל החומרים הנכנסים לבית הם כשרים, ואנו רואים את העובדת בשעת הבישול, כך שאין חשש מצד כשרות המאכלים. האם מותר לאכול מתבשיליה?

תשובה: רבותינו גזרו על תבשילים שבישלום גויים, שלא יאכל מהם ישראל, כלומר, יהודי.

טעם גזירת בישולי גויים
ובטעם הגזירה שאסרו רבותינו לאכול תבשילי גוים, נמצאו שני טעמים, האחד, משום חתנות. כלומר, הואיל ואסור לישראל להתחתן עם הגויים, ואם יהיו ישראל רגילים לאכול ממאכלי הגויים ולשהות בחברתם, הם עלולים לבא לידי נשואין עם הגויים.

והטעם השני, משום שחששו רבותינו, שמא הגוי יכניס דברים לא כשרים בתבשילו, ויאכילם את הישראל.

לפיכך אסור בהחלט לאכול מתבשילים שבישל הגוי.

דין הכלים שהגוי בישל בתוכם
ביארנו כבר בהלכות ערב פסח וכן בהלכות בשר בחלב, שכל כלי שנתבשל בתוכו מאכל כל שהוא, הרי שטעם המאכל נבלע בדפנות הכלי, מחמת חום התבשיל. ולכן אנו מייחדים מערכות כלים נפרדות לחלב ולבשר, וכן לפסח ולשאר ימות השנה.

וכן הדין לגבי תבשילי הגוי, שלא רק שאין לאכול מהתבשילים שבישל הגוי, אלא שדינם כדין כל שאר איסורי האכילה, נבלות וטרפות, בשר בחלב וכדומה, שאם בישלום בכלי, הכלי נאסר להשתמש בו שוב, מכיון שדפנות הכלי בועלות מטעם המאכל שנתבשל בו.

נמצא אם כן, שגוי שבישל תבשילים בכלים של ישראל, לא רק שאסור לאכול את המאכלים שבישל הגוי, אלא שכל הכלים שבישל בהם, נאסרו בשימוש חוזר, אלא אם יכשירו אותם, על ידי "הגעלה" במים רותחים. וכפי שביארנו בערב פסח. (וכלי חרס, שעל פי הדין אין אפשרות להכשירם אפילו בהגעלה, מכל מקום באיסור בישולי גויים, כתב מרן הרב עובדיה יוסף שליט"א, שיש להקל בהגעלת הכלי שלש פעמים, אפילו בכלי חרס). (הליכות עולם עמוד צז, ועמוד קד).

וכשהיה מרן רבינו שליט"א אב בית הדין בקהיר, היתה אשה ערביה אחת מסייעת לרעייתו הרבנית בעבודות הבית. ופעם אירע שהכינה לעצמה חביתה על מחבת השייך למרן רבינו שליט"א ולבני ביתו. והורה מרן שליט"א לרעייתו, שתגעיל את המחבת במים רותחים, ושתעשה כן בנוכחות הערביה, כדי שתלמד מכאן ולהבא שלא לעשות כך עוד. (וכשעזבו מרן שליט"א ובני ביתו את קהיר, עמדה אותה ערביה ומיררה בבכי, על צערה הגדול בפרידתה מהרבנית, ועל הזכות הגדולה שהיא מאבדת בכך שלא תוכל עוד לעמוד לימין רעייתו של החכם הקדוש).

ואמנם ישנם אופנים שמותר לאכול מתבשיל של הגוי, כמו שנבאר בהלכות הבאות

Foods Cooked by a Non-Jew

Question: We currently employ a non-Jewish maid in our home. She helps with things around the house including cooking our food. All of the ingredients which enter the house are kosher and we supervise the maid while she is cooking, such that there is not Kashrut concern with the food. May we eat the food she prepares?

Answer: Our Sages decreed that a Jew may not eat foods cooked by a non-Jew.

The Reason for the Prohibition to Eat Foods Cooked by a Non-Jew
There are two reasons for the why our Sages decreed that a Jew may not eat food cooked by a non-Jew: The first is since a Jew may not marry a non-Jew, if Jews are accustomed to eating with non-Jews and mingling with them, this may cause intermarriage between them.

The second reason is because our Sages were concerned that the non-Jew may place non-kosher ingredients in the food and feed it to the Jew.

Thus, it is absolutely forbidden to eat foods that were cooked by a non-Jew.

The Status of Vessels that a Non-Jew Cooked Food In
We have already discussed in the laws of Pesach and the laws of milk and meat that any vessel which had any kind of food cooked in it absorbs some of the flavor of the food into the walls of the vessel as a result of the heat during the cooking. It is for this reason that we designate different sets of dishes for milk and meat as well as for Pesach and the rest of the year.

The same applies to food cooked by a non-Jew that not only is it forbidden to eat from the food cooked by the non-Jew, but the status of such food is like other forbidden foods such as non-kosher meat, milk and meat, and the like which prohibit the vessel they were cooked in since the walls of the vessel absorb some of the flavor of the forbidden food cooked in it.

Thus, if a non-Jew cooks food in a Jew’s vessels, not only are the foods prohibited for consumption, but the vessels may not be used anymore without first koshering them by immersing them in a pot of boiling water on the fire (“Hag’ala”). (Regarding earthenware vessels, which according to the Halacha cannot be koshered through Hag’ala, nevertheless, regarding the prohibition of food cooked by a non-Jew, Maran Harav Ovadia Yosef Shlit”a writes that one may be lenient and kosher it by immersing it in boiling water on the flame three times, even if it is and earthenware vessel. See Halichot Olam, Volume 7, pages 97 & 104.)

When Maran Shlit”a served as head of the Rabbinical Court in Cairo, there was an Arab maid who would help the rabbi’s wife with chores around the house. This maid once prepared herself an omelet using a frying-pan belonging to Maran’s family. Maran Shlit”a instructed his wife to immerse the pan in boiling water in a pot on the fire in the presence of this maid in order for her to realize that she should not do this again in the future. (When Maran Shlit”a and his family left Cairo, this maid stood and wept bitterly for she was distressed about parting with the rabbi’s wife and because of her loss of the great merit to be a helping-hand to the wife of the holy sage.)

There are, however, instances where it will be permissible to eat food cooked by a non-Jew which we will, G-d-willing, discuss in the following Halachot

התנאים להיתר אכילת בישולי גויים

בהלכה הקודמת ביארנו באופן כללי את האיסור לאכול מתבשילים שבישלם הגוי. וכגון, אם בישל הגוי תפוח אדמה, אסור לאכול ממנו, אף על פי שאין כל חשש מצד כשרות המאכל, מכל מקום גזרו רבותינו איסור אכילה מתבשילים שבישל הגוי, מן הטעמים שהוזכרו בהלכה הקודמת.

אולם בעצם הדין שאין לאכול מבישולי הגוי, ישנם שני תנאים, שבההעדר אחד מהם, מותר לאכול מתבשילי הגוי.

תנאי איסור בישולי גויים
התנאי הראשון הוא, שיהיה התבשיל עשוי ממאכלים שאינם נאכלים כשהם חיים, (חיים, כלומר, אינם מבושלים). כגון תפוחי אדמה, בשר (לרוב סוגיו), אורז וכיוצא בזה. שכל המאכלים הללו אי אפשר לאכלם ללא בישול, ולפיכך אסור לאכלם אם בישלם הגוי.

אבל דבר שנאכל כמות שהוא חי, כגון תפוחים, גזר וכיוצא בזה, שרגילים לאכלם אף ללא בישול, מותר לאכלם אם בישלם הגוי. שכל דבר הנאכל כמות שהוא חי, לא נאסר באכילה מחמת בישול הגוי.

והתנאי השני, שיהיה התבשיל ראוי להעלותו על שלחן מלכים. כלומר, דוקא תבשיל שיש לו חשיבות, כמו בשר ודגים, שייכת בו גזירת רבותינו שלא לאכול מבישולי הגוי. אבל תבשיל פשוט מאד, שאין להעלותו על שלחן מלכים, מותר לאכול ממנו, אף על פי שבישלו גוי.

וכל תבשיל שחסר בו אחד מן התנאים הללו, כלומר, או שהוא נאכל כמות שהוא חי, או שהוא אינו עולה על שלחן מלכים, הרי שמותר לאכלו אפילו אם בישלו הגוי. ואין צורך שיתקיימו שני התנאים יחד.

ובהלכה הבאה, נביא דוגמאות למאכלים שמותר לאכלם, אף על פי שבישלם הגוי. (שלחן ערוך יורה דעה סימן קיג)

The Conditions to Permit Eating Foods Cooked by a Non-Jew

In the previous Halacha we have explained in a general manner the prohibition to eat foods cooked by a non-Jew, for instance, a Jew may not eat a potato cooked by a non-Jew; even if there is no concern as to the Kashrut of the food, our Sages nevertheless forbade eating foods cooked by a non-Jew for the reasons mentioned in the previous Halacha.

However, with regards to the actual prohibition of eating food cooked by a non-Jew there are two conditions which, if they are not both met, it will be permissible to eat the foods cooked by a non-Jew.
The Conditions of when the Prohibition of Foods Cooked by a Non-Jew Applies

The first condition is that the cooked food must consist of foods which cannot be eaten raw or uncooked, such as potatoes, most kinds of meat, rice, and the like; all of these foods cannot be eaten uncooked and will therefore be prohibited for consumption if cooked by a non-Jew.

However, foods which can be eaten as is, uncooked, such as apples, carrots, and the like which are regularly eaten uncooked, may be eaten even if they were cooked by a non-Jew, for anything able to be eaten raw does not become prohibited when cooked by a non-Jew.

The second condition is that the food must be worthy of being served on a king’s table, meaning that only a cooked food which is respectable, such as meat or fish, is included in the edict of our Sages banning food cooked by a non-Jew. However, a very simple dish which is not fit to be served on a king’s table may be eaten even if it has been cooked by a non-Jew.

Any cooked food which is missing any one of these two conditions, i.e. either it is able to be eaten raw or uncooked or it is not worthy of being served on a king’s table, is permitted for consumption even if it was cooked by a non-Jew. It is unnecessary for both conditions to be fulfilled.

In the following Halacha we shall discuss several examples of foods which may be eaten even if they were cooked by a non-Jew (Shulchan Aruch, Yoreh De’ah, Chapter 113)

  1. What benefits did G-d promise Avraham if he would leave his home?
    12:1 – He would become a great nation, his excellence would become known to the world, and he would be blessed with wealth.
  2. "And all the families of the earth will be blessed through you." What does this mean?
    12:3 – A person will say to his child, "You should be like Avraham."
  3. Who were the souls that Avraham and Sarah "made?"
    12:5 – People they converted to the worship of G-d.
  4. What were the Canaanites doing in the Land of Canaan when Avraham arrived?
    12:6 – They were in the process of conquering the land from the descendants of Shem.

Halachot from Maran Rabbi Ovadia Yosef Ztz’l

מאימתי מותר לשבת בחזרת התפילה?

בהלכה הקודמת ביארנו, שמעיקר הדין מותר לשבת בשעת חזרת התפילה שעל ידי השליח ציבור. כלומר, אחר תפילת העמידה שכל אחד ואחד מתפלל בעצמו, מותר לציבור לשבת, ואינם חייבים לעמוד במשך כל זמן החזרה.

אולם יש להבהיר, כי אין לשבת בחזרת התפלה, אלא לאחר שסיים השליח ציבור את ברכת "האל הקדוש". שכן כתב מרן השלחן ערוך (סימן קכג), שלאחר שמסיים כל אחד ואחד מן הציבור את תפילת הלחש, עליו לפסוע שלוש פסיעות לאחריו, ואז יעמוד במקומו ולא יזוז. ולא יחזור למקום שבו התפלל, אלא כאשר יגיע הציבור עם החזן לקדושה (נקדישך ונעריצך). שאז יחזור למקומו ויאמר את נוסח הקדושה כדין. ולאחר הקדושה ישאר במקומו, ויענה ברוך הוא וברוך שמו לברכת "האל הקדוש". ולאחר ברכה זו רשאי לשבת במקומו.

וכתב בספר תורת חיים, שיש לתמוה על מנהג ההמון שמיקלים בדבר זה, ומיד כשמסיימים תפילתם הם יושבים במקומותיהם, וכשמגיע שליח ציבור לקדושה הם עומדים. שמנהג זה עומד בניגוד למה שפסק מרן השלחן ערוך הנ"ל, שלכל הפחות חייבים לעמוד במקומם עד שיתחיל השליח ציבור את חזרת הש"ץ, שאז מותרים הם לחזור למקומם הראשון בשתיקה, ושם יענו לקדושה שבחזרת התפילה. ומן הראוי לעורר את לב העם לכך. עד כאן עיקר דבריו.

ומרן רבינו הקדוש רבי עובדיה יוסף זצ"ל (הכ"מ), גם בערוב ימיו, כשהיה חלש, ורגליו כואבות, היה עומד תמיד על מכונו, לאחר שסיים את התפלה, והיה ממתין לשליח ציבור עד אחר הקדושה. ורק אז היה מתיישב על מקומו.

ועוד יש להעיר, אודות מה שיש נוהגים, שבשעה שמגיע החזן לברכת "מודים", הם אינם עומדים במקומותיהם לעניית "מודים", אלא נשארים יושבים, ומסתפקים בקימה מועטת לעניית מודים. שמנהג זה אינו נכון, כי חובה עלינו לכרוע בשעת אמירת "מודים", וכאשר אדם יושב, הכריעה שהוא עושה אינה נחשבת כריעה מצד ההלכה, ולכן פסק מרן רבינו זצ"ל, שחייב כל אדם לעמוד בשעה שמגיע החזן לברכת מודים, כדי שיוכל לכרוע כדין וכפי מצות חכמים.

ואם הוא זקן או חולה שאינו יכול לעמוד אלא במאמץ גדול, יוכל להקל ולשבת מיד כשמסיים תפילתו, ועד עניית הקדושה, ולאחר מכן ישב עד אמירת מודים, ואז יענה מודים כשהוא יושב, ויכרע מעט כשהוא יושב. אבל אדם בריא, חייב לעמוד ממש, כדי שיוכל לכרוע כדין.

ולסיכום: כשמסיים אדם את תפילתו, עליו לפסוע שלוש פסיעות לאחריו. וישאר עומד במקומו עד שיגיע החזן לקדושה, שאז יחזור למקום בו עמד בתפילתו, ויענה לקדושה. וישאר עומד על מקומו עד סיום ברכת "האל הקדוש", ולאחר ברכת האל הקדוש רשאי מעיקר הדין לשבת במקומו, עד שיגיע החזן ל"מודים", ואז יעמוד ויכרע באמירת "מודים", ויוכל לחזור ולשבת בסיום אמירת "מודים".

At What Point During the Chazzan’s Repetition of the Amida May One be Seated?

In the previous Halacha we have explained that, according to the letter of the law, one may sit during the Chazzan’s repetition of the Amida. This means that after one has concluded one’s personal, silent Amida, the congregation may be seated and need not remain standing for the entire duration of the Chazzan’s repetition.

Nevertheless, we must point out that one may only be seated during the Chazzan’s repetition once the Chazzan has concluded the "Ha’El Ha’Kadosh" blessing. Indeed, Maran Ha’Shulchan Aruch (Chapter 123) states that when one concludes one’s silent Amida, one should take three steps back and then stand in that very same place and not move. One may only return to the original place one prayed (i.e. by taking three steps forward) when the Chazzan and congregation reach the Kedusha ("Nakdishach Ve’Na’aritzach") at which point one should return to one’s original place and recite Kedusha along with the congregation. After the Kedusha is concluded, one should remain standing in place until one has answered "Baruch Hu U’Varuch Shemo" and Amen to the "Ha’El Ha’Kadosh" blessing. Only at the conclusion of this blessing may one be seated.

The Sefer Torat Chaim wonders about the common custom that many have to be seated immediately upon concluding their silent Amida and then rise when the Chazzan reaches the Kedusha, for this custom is contrary to the ruling of Maran Ha’Shulchan Aruch who writes that one must remain in place at least until the Chazzan begins the repetition of the Amida, at which point one is permitted to return to one’s original place silently and recite the Kedusha along with the congregation. One should point this law out to as many people as possible.

Indeed, Maran Rabbeinu Ovadia Yosef zt"l would stand in place after having concluded his Amida prayer, even when he was advanced in age and his feet hurt, and he would only be seated once the Chazzan had concluded the Kedusha. Furthermore, another issue that must be addressed is that when the Chazzan reaches the "Modim" blessing, many individuals do not rise to recite "Modim"; rather, they do so while remaining seated and only having risen ever so slightly. This custom is incorrect, for one is obligated to bow while reciting "Modim" and any bowing exercised while seated has no halachic significance. It is for this reason that Maran zt"l that the entire congregation must rise when the Chazzan reaches the "Modim" blessing, in order to be able to bow in accordance with the edict of our Sages.

If one is elderly or infirm such that standing requires much strain and effort, one may be seated immediately upon concluding one’s silent Amida prayer until Kedusha is recited (at which point one must rise) and one may then be seated again upon conclusion of the Kedusha. When the Chazzan reaches "Modim", such a person may recite "Modim" while remaining seated, albeit by bowing while raising one’s body slightly. However, a healthy person must rise completely in order to be able to bow according to Halacha.

Summary: Upon concluding one’s silent Amida prayer, one must take three steps back and remain standing in that very place until the Chazzan reaches Kedusha, at which point one should take three steps forward and return to the place one had originally prayed in order to recite Kedusha along with the congregation. One must remain in this position until the Chazzan concludes the "Ha’El Ha’Kadosh" blessing, at which point one may, according to the letter of the law, be seated until the "Modim" blessing. When the Chazzan reaches the "Modim" blessing, one must rise, bow, and recite "Modim" after which one may once again be seated.

  1. Which particular sin sealed the fate of the flood generation?
    6:13 – Robbery.
  2. Why did Hashem tell Noach to build an ark, as opposed to saving him via some other method?
    6:14 – So that people would see Noach building the ark and ask him what he was doing. When Noach would answer, "Hashem is bringing a flood," it might encourage some people to repent.
  3. The ark had three levels. What function did each level serve?
    6:16 – The top level housed the people, the middle level housed the animals, and the bottom level, the refuse.
  4. What indication do we have that Noach was familiar with the Torah?
    7:2 – Hashem told him to take into the ark seven of each kosher-type animal, and two of each non-kosher type. "Kosher" and "non-kosher" are Torah concepts.

דין הזכרת משיב הרוח

מתחילין לומר "משיב הרוח"
"משיב הרוח ומוריד הגשם", הוא שבח להשם יתברך, שאנו אומרים אותו בימות החורף, בתפלת העמידה, בברכת "מחיה המתים". וכפי שמופיע בכל הסידורים.

מתחילין לומר "משיב הרוח ומוריד הגשם" החל מתפילת מוסף של חג שמחת תורה, והזכרה זו, אינה שאלה ובקשה על הגשם, אלא היא שבח להשם יתברך, ולכן הזכרה זו נקראת "גבורות גשמים", שמדברת מענין גבורותיו של השם יתברך בעולמו.

אבל שאלת "טל ומטר" שבברכת השנים, (כלומר, בברכת ברך עלינו, או ברכנו, שאומרים "ותן טל ומטר לברכה"), היא בקשה מהשם יתברך על הגשם. וישנם כמה הבדלים בהלכה, בין הזכרת גבורות גשמים שבברכת "אתה גבור", לבין שאלת טל ומטר שבברכת השנים, והשינוי הראשון הוא, שמזכירין גבורות גשמים, כבר מתפילת מוסף של שמחת תורה, ואילו שאלת גשמים, אינה אלא מליל שבעה במרחשון כפי שיתבאר בהלכות הבאות.

מדוע מזכירים משיב הרוח בברכת מחיה המתים?
אמרו בגמרא (ברכות לג.), שמזכירין גבורות גשמים ("משיב הרוח") בברכת "אתה גבור", שהיא ברכת "מחיה המתים", משום שהיא ברכה על תחיית המתים, ומתוך שירידת גשמים שקולה כנגד תחיית המתים, לפיכך קבעוה בתחיית המתים. ושאלת גשמים ("ותן טל ומטר לברכה"), קבעו בברכת השנים, משום שברכת השנים היא ברכה על פרנסה, וירידת גשמים גם היא ענין פרנסה לעולם.

מי ששכח להזכיר "משיב הרוח ומוריד הגשם"
מי ששכח להזכיר משיב הרוח ומוריד הגשם, ונזכר לאחר שסיים את ברכת "מחיה המתים", יש לבאר, האם עליו לחזור לתחילת תפלת העמידה ולהתפלל שנית, או שהוא רשאי להמשיך בתפלתו. והנה הדין בזה הוא תלוי, שאם אמר "מוריד הטל" במקום "משיב הרוח ומוריד הגשם (כפי מנהג הספרדים בימות הקיץ), אינו חוזר לראש התפלה. כיון שאמר "מוריד הטל".

אבל אם לא הזכיר כלל, לא "מוריד הטל", ולא "משיב הרוח", (כפי מנהג חלק מעדות האשכנזים בימות הקיץ), ונזכר בטעותו מיד לאחר שסיים את ברכת "מחיה המתים", עליו לומר מיד "משיב הרוח ומוריד הגשם", ואחר כך ימשיך בברכת "אתה קדוש". ואם התחילה כבר בברכת "אתה קדוש", ונזכר שלא אמר "משיב הרוח", הרי אין לו תקנה, ועליו לחזור שוב לראש התפלה.

The Laws of Mentioning “Mashiv Ha’Ruach”

We Begin Reciting “Mashiv Ha’Ruach
Mashiv Ha’Ruach U’Morid Ha’Geshem” is a praise we recite to Hashem during the winter months within the “Mechayeh Ha’Metim” blessing of the Amidah as is printed in all Siddurim.

We begin reciting “Mashiv Ha’Ruach U’Morid Ha’Geshem” in the Mussaf prayer of Simchat Torah (outside of Israel from Shemini Atzeret). This recitation does not constitute a request or plea for rain; rather, it is merely meant as praise to Hashem and is therefore dubbed, “Powers of Rain.” The actual request for dew and rain can be found in the ninth blessing of the Amidah prayer referred to as the “Blessing of the Years” (Barech Aleinu). There are several halachic differences between mentioning the “Powers of Rain” in the second blessing of the Amidah prayer entitled, “Ata Gibor,” and the actual request for dew and rain in the ninth blessing. Firstly, whereas we begin mentioning the “Powers of Rain” from Mussaf of Shemini Atzeret, we do not actually request dew and rain until the night of the Seventh of Marcheshvan (outside of Israel from the night of the Fifth of December), as we shall discuss in following Halachot.

Why is “Mashiv Ha’Ruach” Mentioned in the “Mechayeh Ha’Metim” Blessing?
The Gemara (Berachot 33a) states that we mention the “Powers of Rain” in the “Ata Gibor” blessing for this blessing deals with the Resurrection of the Dead and since rainfall is tantamount to The Resurrection, our Sages thus established this sentence to be mentioned in the blessing dealing with The Resurrection. Our Sages established the actual request for rain in the “Blessing of the Years,” for this is a blessing regarding one’s livelihood and rainfall is a matter of sustenance for the entire world.

One Who Forgets to Mention “Mashiv Ha’Ruach
If one forgets to recite “Mashiv Ha’Ruach” and becomes aware of his mistake only after concluding the “Mechayeh Ha’Metim” blessing, we must analyze whether one must return to the beginning of the Amidah prayer and begin it again or may one continue his prayer as usual. This law indeed depends on one important factor: If one inserted “Morid Ha’Tal” instead of “Mashiv Ha’Ruach” (as is the Sephardic custom during the summer months), one would not return to the beginning of the Amidah prayer since one has said “Morid Ha’Tal.”

However, if one mentioned neither “Mashiv Ha’Ruach” nor “Morid Ha’Tal” (which is indeed customary among several Ashkenazi communities during the summer months), if one has not yet begun the “Ata Kadosh” blessing, one should recite “Mashiv Ha’Ruach U’Morid Ha’Geshem” between the “Mechayeh Ha’Metim” and “Ata Kadosh” blessings and then just continue his prayer as usual. If, however, one has already begun the “Ata Kadosh” blessing and only then realizes his mistake, one must begin his Amida prayer anew.

דיני חג הסוכות

לפי בקשת מנויים רבים ולתועלת הציבור, הנה אנו מגישים קיצור דינים הנצרכים לימי חג הסוכות הבאים עלינו לטובה

1. הסוכה צריכה להעשות משלש דפנות וסכך, ואת הדפנות ניתן לעשות מכל דבר העומד בפני רוח, למעט סדינים וכדומה שאינם כשרים לדפנות.

2. אם עושים את הדפנות מברזל או פלסטיק וכיוצא בזה מדברים שאין גידולם מן הארץ, אין להניח על גביהן את הסכך, אלא בהפסק של נסרים של עץ וכדומה, שהוא דבר הגדל מן הארץ ואינו מקבל טומאה.

3. הסכך צריך שיהיה מדבר הגדל מן הארץ, כגון נסרים של עץ וענפי אילנות וכדומה. וצריך שיהיה הסכך תלוש מן הקרקע, למעט אילן המחובר לקרקע שאין לסכך בו. וכן צריך שיהיה הסכך מדבר שאינו מקבל טומאה, למעט מיני אוכלים או כלי עץ, כגון ארגז או תיבה של עץ. מפני שכל אלו הם ראויים לקבל טומאה. ומחצלת של קש, שמן הסתם עשוייה לשכיבה, פסולה לסיכוך, שהרי היא ראויה לקבל טומאה, אבל מחצלת של קנים שעשויה לשם סכך, כשרה לסכך בה ללא חשש.

4. הקישוטים שנוהגים לתלות תחת סכך הסוכה, בכדי ליפות את הסוכה, הרי הם עלולים לפסול את הסוכה מפני שהם אינם סכך כשר, ולכן כתב מרן הרב עובדיה יוסף שליט"א, שצריך לתלות את קישוטי הסוכה שתחת הסכך, באופן שיהיו צמודים לסכך ותלויים בתוך ארבעה טפחים לסכך, (שהם שלושים ושניים סנטימטר,) ולא יהיו יורדים מן הסכך שיעור ארבעה טפחים שאז יש חשש פן יפסלו את הסוכה כאמור, אבל כשהם בתוך ארבעה טפחים, בטלים הם לגבי הסכך ואין כל חשש שיפסלו את הסוכה, אפילו אם הם גדולים מאד.

5. יש לעשות את הסיכוך באופן קל, שהכוכבים הגדולים נראים דרכו, ומכל מקום בדיעבד אפילו אם אין הכוכבים נראים דרכו, כשירה. אבל אם עשה את הסכך עבה כל כך עד שאפילו הגשמים אינם חודרים דרכו, יש לחוש לפסול סוכה זו. ויש להזהר שלא לעשות את הסוכה תחת מרפסת אחרת או תקרה, שסוכה כזו פסולה מן הדין.

6. בערב חג הסוכות לא יאכל פת לחם בשיעור של יותר מכביצה פת, משעה עשירית ולמעלה, (בערך משעה 2 בצהריים), כדי שיוכל לאכול את הסעודה של ליל החג לתיאבון. ויש מחמירים בזה מחצות היום ואילך. ובמקום צורך יש לסמוך על המיקלים.

7. מצות עשה מן התורה לאכול כזית פת בלילה הראשון של חג הסוכות בסוכה. וצריך לכוין קודם אכילתו שהוא יושב בסוכה זכר ליציאת מצרים, ושהוא בא לקיים מצות עשה באכילתו.

8. בשאר ימי חג הסוכות, אין חיוב לאכול סעודה עם פת, אבל אם רוצה לאכול פת בשיעור של יותר מכביצה, חייב לאכול בסוכה. ויברך לישב בסוכה, וכמו שהארכנו בענין זה.

9. מותר לאכול פירות וירקות מחוץ לסוכה, וכן מותר לאכול אורז חוץ לסוכה, וכל שכן שמותר לשתות מחוץ לסוכה, מים או מיץ. ואם אוכל פת כסנין, כלומר עוגה, אם אוכל יותר מכביצה, צריך לאכול בסוכה, אבל לא יברך על אכילה זו. ואם אוכל כשיעור קביעות סעודה, (ולענין סוכה שיעור זה הוא כשיעור מאה ששים ושתיים גרם), צריך לברך לישב בסוכה, וכמו שהסברנו כבר.

10. כאשר אוכל בסוכה אכילה שצריך לברך עליה ברכת לישב בסוכה, לכתחילה הנכון יותר הוא, שיברך לישב בסוכה לפני שמתיישב לאכול, ולאחר הברכה יישב ויברך על מה שאוכל ויאכל לשובע נפשו.

The Laws of the Holiday of Sukkot

As per the request of many of our members and as a public service, we shall now list a synopsis of some laws which are essential for the upcoming Sukkot holiday:

  1. The Sukkah must be made of three walls and Sechach (the roof). The walls may be made of any material which can withstand a normal wind, excluding sheets and the like which cannot and are thus invalid.
  1. If the walls are made from metal, plastic, or anything else which does not grow from the ground, one should not place the Sechach directly on them; rather, one should place some wooden beams on top of the walls and place the Sechach on these beams, for these beams grow from the ground and thus are incapable of becoming impure.
  1. The Sechach must be made of something that grows from the ground, for instance, wooden slats, tree branches, and the like. Likewise, it must be detached from the ground as opposed to a tree which is still attached to the ground and cannot be used. Similarly, the Sechach must be made of material that is unable to become impure, excluding foods or wooden vessels such as wooden crates or chests, for these are indeed capable of becoming impure. A mat made of straw which is usually made for lying on is capable of becoming impure and is thus invalid for use as Sechach. However, mats made of reeds (or bamboo) specially made for use as Sechach are completely valid for use as Sechach.
  1. Decorations hung from the Sechach to beautify the Sukkah may in fact invalidate the Sukkah in certain instances since they are not valid to be used as Sechach. Therefore, Maran Harav Ovadia Yosef z’l writes that one must be sure to hang these decorations in close proximity to the Sechach, i.e. within four Tefachim (32 cm). The decorations should not hang down more than 32 cm from the Sechach, for they can invalidate the Sukkah in this way, as we have explained. However, when the decorations are within 32 cm of the Sechach, they are considered to be a part of the Sechach and there is no concern for invalidation of the Sukkah, even if they are quite large.
  1. The Sechach should be made in a light manner, such that large stars can be seen through it. Nevertheless, even if one made the Sechach in a way that stars cannot be seen through it, it is still valid. However, if one made the Sechach so thick that rain cannot pass through it, one should be stringent and invalidate such a Sukkah. One should likewise be careful not to build his Sukkah under a balcony or roof, for this kind of Sukkah is invalid according to the letter of the law.
  1. On Erev Sukkot, one should not eat over an egg’s volume (approximately 54 grams) of bread past the tenth halachic hour of the day (from approximately two o’clock PM and on), so that one will be able to eat the festive holiday meal that night with an appetite. Some are stringent and abstain from this beginning from halachic midday. When necessary, one may rely on the more lenient view.
  1. There is a positive Torah commandment to eat an olive’s volume (approximately 27 grams) of bread in the Sukkah on the first night of Sukkot. Before eating, one should have in mind that he is sitting in the Sukkah in commemoration of the Exodus from Egypt and that he is fulfilling a positive Torah commandment with this eating.
  1. On the other days of the Sukkot holiday (besides the second night in the Diaspora), there is no obligation to have a bread meal; however, if one wishes to eat more than an egg’s volume of bread (approximately 54 grams), one must do so in the Sukkah. In this case, one must recite the blessing of “Baruch Ata Hashem Elokeinu Melech Ha’Olam Asher Kideshanu Bemitzvotav Vetzivanu Leeshev Ba’Sukkah,” as we have discussed at length previously.
  1. One may eat fruits, vegetables, and rice outside of the Sukkah; one may certainly drink water or juice outside of the Sukkah. If one wishes to eat more than an egg’s volume of cake or other pastries, one must do so in the Sukkah, however, one would not recite the “Leeshev Ba’Sukkah” blessing in this instance. If one plans on eating an amount of cake or pastries which others would consider a meal (approximately 162 grams), one would need to recite the blessing of “Leeshev Ba’Sukkah."
  1. When one eats a food in the Sukkah which requires the “Leeshev Ba’Sukkah” blessing, it is preferable to recite this blessing before one sits down to eat. After reciting the blessing, one should have a seat, recite the appropriate blessing for what is eating, and begin to enjoy his meal.

ערב יום הכפורים

מצות אכילה בערב יום הכפורים

כתוב בתורה (ויקרא כג.) "ועניתם את נפשתיכם בתשעה לחודש בערב". כלומר, מליל עשירי בתשרי, חלה החובה להתענות תענית יום הכפורים. והקשו רבותינו (במסכת ברכות דף ח.) על לשון הפסוק "בתשעה לחודש בערב", שלכאורה היה נכון יותר לכתוב "בעשירי לחודש", וממילא נדע שחובה להתענות כבר מליל עשירי בתשרי, שהרי בכל דיני תורתינו, היום הולך אחר הלילה שלפניו, וכגון ביום השבת, שמזמן שקיעת החמה ביום שישי, נכנסת שבת.

ותירצו רבותינו שהטעם שנכתב בפסוק "בתשיעי לחודש בערב", כדי ללמדינו, שכל האוכל ושותה בתשיעי, מעלה עליו הכתוב כאילו התענה תשיעי ועשירי. וראוי למעט במלאכה בערב יום הכפורים, כדי שיוכל להרבות באכילה ושתיה, וכל העושה מלאכה בערב יום הכפורים אינו רואה סימן ברכה לעולם מאותה מלאכה.

וכמה טעמים נאמרו על מצוה זו. הרא"ש כתב, שהטעם שצונו הקדוש ברוך הוא במצוה זו, שבאהבתו אלינו צוונו להתענות ביום הכפורים כדי לכפר על עוונותינו, וציוה עלינו להתחזק באכילה ושתיה קודם יום הכפורים, כדי שנוכל להתענות למחר.

ובספר שבלי הלקט כתב, להיפך, שכאשר אדם אוכל ושותה בערב יום הכפורים, התענית קשה עליו ביותר, ובזה מקיים מצות "ועניתם את נפשתיכם". ובספר שפת אמת כתב טעם נוסף, שכאשר אדם אוכל ושותה, הוא שמח וטוב לב, ומתוך כך יראה לפייס את חבירו בערב יום הכפורים.

וכתב מרן הרב עובדיה יוסף שליט"א, שאף הנשים חייבות במצוה זו להרבות באכילה ושתיה בערב יום הכפורים, ואף על פי שנשים פטורות ממצות עשה שהזמן גרמא, וכאן המצוה היא בקום עשה, לאכול, מכל מקום, מכיון שהרא"ש כתב שטעם המצוה הוא כדי שנתחזק לקראת התענית, והנשים אף הן מחויבות בתענית, אם כן, גם הן שייכות בציווי להתחזק לקראת התענית.

מנהגי ערב יום הכפורים
כתב רבנו יוסף חיים זצ"ל, שחייב כל אדם לבקש מחילה מאביו ואימו בערב יום הכפורים, על כל מה שחטא להם ופגע בכבודם, ומי שאינו עושה כן נקרא חוטא, ומזלזל בכבוד אביו ואימו, שאם בין אדם לחברו חייבו חז"ל לבקש מחילה מחברו, כל שכן מאביו ואמו שכמעט אין אדם ניצול מחטא זה בכל יום. (עד כאן). וכן ראוי לבני זוג שימחלו זה לזו וזו לזה על כל מה שלא נהגו כשורה אחד עם השני במשך כל השנה.

בערב יום הכפורים, נוהגים להתפלל תפלת מנחה, בעוד היום גדול, דהיינו בשעה מוקדמת, ובתפילת העמידה, אומר כל אחד פסוק "יהיו לרצון אמרי פי והגיון לבי לפניך ה’ צורי וגואלי", ואחר כך אומר וידוי ו"על חטא" כפי שנדפס במחזורים. ואז ילך לביתו ויאכל סעודה מפסקת, שהיא הסעודה האחרונה שאוכל לפני תחילת התענית. ויש לפרוש מכל חמשת העינויים, אכילה, שתיה, רחיצה, נעילת נעלי עור, ותשמיש המיטה, מלפני שקיעת החמה. (ומצוה מן התורה להתחיל בכל דיני התענית קודם שקיעת החמה וראוי לנהוג כן לפחות כרבע שעה קודם שקיעת החמה).

מצוה להדליק נרות לכבוד יום הכפורים, וקודם ההדלקה יש לברך "אשר קדשנו במצוותיו וצוונו להדליק נר של יום הכפורים". ואין לאשה לברך עם ההדלקה ברכת שהחיינו, אלא לאחר חליצת נעליים, שרק אז רשאים לברך שהחיינו, משום שבברכת שהחיינו מקבלת עליה קדושת יום הכפורים, ומיד היא חייבת בכל חמשת העינויים.

נוהגים להתעטף בטלית קודם שקיעת החמה (כדי שיוכל לברך עליה), ומתפללים כל תפילות יום הכפורים בטלית, כדי שיתפלל עמו בכוונה.

Erev Yom Kippur

The Mitzvah to Eat on Erev Yom Kippur

The Torah (Vayikra 23) states: “And you shall oppress yourselves on the ninth of the month at night,” meaning that the obligation to fast on Yom Kippur begins from the night of the tenth of Tishrei. Our Sages (Berachot 8a) inquired about the language of the verse, “The ninth of the month at night,” that would it not make more sense to write “the tenth of the month” and we shall understand by default that the obligation to fast begins from the night of the tenth as we find regarding all other laws of the Torah the day begins with the preceding night, as we find by Shabbat which begins from sunset on Friday evening?

Our Sages answered that the reason why the verse states, “The ninth of the month at night,” is in order to teach us that anyone who eats and drinks on the ninth of the month, it is considered as if he has fasted for the ninth and tenth of the month. It is preferable to minimize one’s workload on Erev Yom Kippur in order that one is able to eat and drink copiously. Anyone who performs work on Erev Yom Kippur shall never see any blessing from the money he earns on that day.

There are several reasons given for this Mitzvah. The Rosh writes that the reason Hashem commanded us to perform this Mitzvah is because since Hashem, with all of His love, commanded us to fast on Yom Kippur in order to atone for our sins, He thus commanded us to strengthen ourselves by eating and drinking before Yom Kippur so that we may fast the next day. The Shiboleh Ha’Leket writes that, on the contrary, when one eats and drinks on Erev Yom Kippur, the fast the next day is harder for him and in this way one fulfills the verse, “You shall oppress yourselves.” The Sefat Emet writes an additional reason, that when one eats and drinks, this gladdens him and as a result he will come to appease his friend on Erev Yom Kippur.

Maran Harav Ovadia Yosef Shlit”a writes that women are also obligated in this Mitzvah to eat and drink plentifully on Erev Yom Kippur. Although women are exempt from performing positive Mitzvot which are time-bound and in our situation the Mitzvah is to actively go and eat, nevertheless, since the Rosh writes that the reason for this Mitzvah is in order to give us strength for the upcoming fast and women are also obligated to fast, they are also subsequently obligated to strengthen themselves in preparation for the fast.

Some Customs Pertaining to Erev Yom Kippur
The great Rabbeinu Yosef Haim zt”l writes that one is obligated to ask for his parents’ forgiveness on Erev Yom Kippur for all of the sins he has committed against them and all of the ways he has insulted their honor. One who does not do so is considered a sinner and treats the respect of his father and mother lightly, for if our Sages required one to ask one’s friends and fellows for forgiveness, certainly one ask for his parents’ forgiveness, for it is almost impossible not to transgress this prohibition daily. It is likewise worthy for spouses to forgive one another for all of the inappropriate behavior and angst that they caused each other throughout the year.

It is customary to pray Mincha at an early hour on Erev Yom Kippur. In the Amidah prayer, after reciting the verse, “Yihyu Leratzon Imrei Fi Vehegyon Libi Lefanecha, Hashem Tzuri Vego’ali,” one recites Viduy (the confessional prayer) and “Al Chet” as is printed in Yom Kippur Machzorim. Then, one should proceed home and eat his last meal before the onset of the fast. One should begin to abstain from the five prohibitions that apply on Yom Kippur (i.e. eating and drinking, washing, rubbing one’s self with oils or lotions, wearing leather shoes, and marital relations) before sunset. (It is a Torah commandment to begin abstaining from all the Yom Kippur-related prohibitions before sunset; it is preferable to do so at least fifteen minutes before sunset.)

It is a Mitzvah to light candles in honor of Yom Kippur. Before lighting, one should recite the blessing of, “Baruch Ata Hashem Elokeinu Melech Ha’Olam Asher Kideshanu Bemitzvotav Vetzivanu Le’Hadlik Ner Shel Yom HaKippurim.” A woman should not recite the Shehecheyanu blessing along with the blessing on the candles until she has removed her leather shoes; only after doing so can one recite this blessing, for by reciting this blessing, she accepts upon herself the sanctity of Yom Kippur and becomes obligated to abstain from the five prohibitions immediately.

It is customary to wrap one’s self in his Tallit before sunset (so that one will be able to recite the blessing); all of the Yom Kippur prayers are recited while wearing a Tallit so that one can pray with concentration while it is on him.

“Kaparot” is customarily performed during these days (i.e. the Ten Days of Repentance). Some fulfill this custom using chickens while others use money, as we have discussed in the Halacha regarding the Custom of Kaparot.

מנהג הכפרות

: האם יש לקיים את מנהג הכפרות בתרנגולים דוקא, או שטוב יותר לקיימו על ידי מעות בלבד?

תשובה
: נהגו בכל תפוצות ישראל לעשות כפרות בערב יום הכפורים, לשחוט תרנגולים לכל בני הבית, ונוהגים ליקח תרנגול זכר לכל אחד מבני הבית הזכרים, ותרנגולת נקבה לכל אחת מבנות הבית הנקבות. ובעת שמסובב התרנגול סביב לראש המתכפר, אומר, זה חליפתך זה תמורתך זה כפרתך, וכפי שנדפס במחזורים, וכשמסובב סביב עצמו יאמר, זה חליפתי וכו’. ומנהג זה נהגו לעשותו בעשרת ימי תשובה, כלומר, בימים אלה, אחר יום ראש השנה לפני יום הכפורים.

אלא שהרשב"א בתשובה (סימן שצה) כתב, מנהג הכפרות שעושים בערבי יום כפור, מצאתיו מנהג פשוט בעירנו, עם עוד דברים שנראו בעיני שהם כדרכי האמורי, (דהיינו מנהג גויים), והרחקתי מנהג זה הרבה, וצותי לבטלו, ואף ששמעתי שדבר זה נשאל לרב האי גאון, ואמר שכן נהגו, עם כל זה מנעתי המנהג. עד כאן. גם מרן השלחן ערוך כתב שיש למנוע מנהג זה, וכשיטת הרשב"א. וכן פסק גם בספר פרי חדש ועוד.

ומכל מקום מרן הרב עובדיה יוסף שליט"א כתב, שמכיון שכבר פשט מנהג זה, הן אצל עדות האשכנזים והן אצל עדות הספרדים, ומכיון שכך גם דעת הגאונים לקיים מנהג זה, וכן כתבו לקיים המנהג עוד רבים מגדולי הפוסקים, לכן הנח להם לישראל במנהגם. ובפרט שנוהגים ליתן הכפרות או דמיהן (דהיינו כסף כנגד מחיר עוף אחד לכל אדם), לעניים, ובזה יש מקום לומר שגם הרשב"א מודה להתיר, כיון שיש טעם בדבר על על פי פשוטן של דברים.

אולם כל זה מצד החשש שדומה הדבר לדרכי האמורי, שמצד זה יש להקל בדבר ולהעמיד את המנהג על מקומו. אך יש לעורר על ענין אחר, והוא, שבמקומות רבים נעשה מנהג הכפרות בצורה המונית, והשוחטים עומדים במשך שעות מרובות לשחוט, וידיהם עייפות, ופעמים רבות אינם שוחטים כדין. וכבר לפני למעלה מששים שנה היה מרן הרב שליט"א מעורר על הדבר, ואומר שמרן השלחן ערוך אמר שהוא מנהג האמורי, ובאמת שהוא מנהג החתי והאמורי, כי הרבה חטאין נגרמים בעבורו. ולכן יש להזהר מאד ,שתעשה שחיטת העוף כדת וכדין, על ידי שוחט מומחה וירא אלוקים. ומכל מקום ניתן גם לקיים מנהג הכפרות במעות שיסובב סביב ראש המתכפר ויאמר, זו חליפתך וכו’, אלו המעות ילכו לצדקה ותכנס אתה לחיים טובים ולשלום, וכן היה נוהג במשך שנים מרן הרב שליט"א.

אלא שיש להוסיף בזה, כי רבותינו המקובלים הרבו בשבח מנהג הכפרות שנוהגים לעשותו בתרנגולים דוקא, כי יש בכך כפרה לנפש האדם הנקרא "גבר", כשם שהתרנגול נקרא "גבר", וגם רבינו קדוש ה’ האר"י ז"ל כתב בשבח המנהג על ידי תרנגולים דוקא, ועל כן יש ענין גדול לנהוג במנהג הכפרות דוקא על ידי תרנגולים. וגם מרן רבינו הגדול שליט"א, אף שכאמור במשך שנים היה נוהג לקיים את מנהג הכפרות במעות בלבד, מכל מקום בשנים האחרונות שינה ממנהגו בזה, וחזר לקיים את מנהג הכפרות בתרנגולים, וכן הורה לקרוביו, שנכון יותר לקיים את מנהג הכפרות בתרנגולים. ועל כן, מי שיש בידו לקיים את המנהג בתרנגולים, שאחר כך יועברו הם או דמיהן לעניים, רצוי מאד שיעשה כן לתועלת נפשו.

ואין צורך להזכיר את גודל איסור צער בעלי חיים, כמו שיש אומרים בגמרא (בבא מציעא לב., ועי’ שבת קנד. ובש"ע חו"מ סימן ערב) "צער בעלי חיים דאוריתא", שיש בזה איסור חמור מאד שמביא גם קטרוג גדול על האדם, ולכן יש להזהר מאד לנהוג כדת בעופות המובאים לקיום מנהג הכפרות, שלא יבאו לידי מיתה או צער בחינם. ולכן יש לקיים מנהג זה רק במקום בו הוא מקויים תחת השגחה כראוי, שתהיה גם השחיטה כדת, ושלא יעשו על תרנגול אחד כפרות כמה פעמים כדרך הרמאים. ואם אין אפשרות לקיים את המנהג בצורה נכונה, אין ספק שעדיף יותר לקיימו על ידי מעות בלבד ולא על ידי תרנגולים. וה’ הטוב יכפר, ואחד המרבה ואחר הממעיט ובלבד שיכוין את לבו לאביו שבשמים

The Custom of Kaparot

Question: Should one fulfill the custom of Kaparot specifically using chickens or should one merely use money?

Answer: It is customary among all Jewish communities to perform Kaparot on Erev Yom Kippur by slaughtering chickens for every member of one’s household. It is customary to use a rooster (male chicken) for every male member of one’s household and a hen (female chicken) for every female member of one’s household. While circling the chicken around the head of the one being atoned for, one recites: "This is your substitute, replacement, atonement etc." as is printed in the Machzorim. When circling one’s own head with a chicken, one should recite: "This is my substitute etc." It is customary to do this during the Ten Days of Repentance, i.e. during this period between Rosh Hashanah and Yom Kippur.

Nevertheless, the Rashba writes in one of his responses (Chapter 395): "Regarding the Kaparot custom which is performed on Erev Yom Kippur, I have found this to be the widespread custom in our city along with other things which seem to me are pagan customs; I have distanced this custom very much and I have ordered that it be nullified. Although I have heard that Rav Hai Gaon was asked about this [custom] and he replied that this was indeed the custom, I have nevertheless discontinued its practice." Similarly, Maran HaShulchan Aruch writes that this custom should be discontinued as per the Rashba’s opinion. The Peri Chadash and other Poskim rule likewise.

Nevertheless, Maran Harav Ovadia Yosef Shlit"a writes that since this has become the prevalent custom among Ashkenazi as well as Sephardic communities in addition to the fact that the Geonim and many other great Poskim uphold this custom, they may thus continue with their custom. This is especially true when the Kaparot or their value (meaning the monetary value of one chicken per person) are being donated to the needy, for in this case it would seem that even the Rashba would agree that it is permissible since there is an understandable reason for doing so according to the simple meaning of this matter.

All this only applies to the fact that this custom resembles pagan rituals, in which case we say that one may be lenient and keep this custom in place. However, we must raise another issue, regarding the fact that in many places, Kaparot are performed as a large-scale operation and when the slaughterers stand for hours on end slaughtering, their hands may become weak and the slaughtering may not necessarily be performed as prescribed by Halacha. Maran Harav Shlit"a would raise this issue close to sixty years ago and would say that according to Maran HaShulchan Aruch, this is a pagan ritual, and when done in this way, it most certainly is, as many evils result from this. Thus, one should take care that the slaughtering of the chickens should be done according to Halacha by an expert and G-d-fearing slaughterer. Nevertheless, one may fulfill the custom of Kaparot by circling money around the head of the one being atoned for and reciting, "This [money] is your substitute etc. this money shall be given to charity and you shall be bestowed with a good life and peace." This was indeed the custom of Maran Harav Shlit"a for many years.

Nevertheless, we must add that the Mekubalim speak very highly about performing Kaparot specifically with chickens, for this provides an atonement for a person is called "man," just as a rooster is called "man." Similarly, the saintly Ariz"l speaks very highly about performing Kaparot specifically using chickens as well. It is this truly important to perform Kaparot specifically using chickens. Although, as we have said earlier, Maran Harav Shlit"a had used money to perform Kaparot for several years, he has nevertheless changed his custom and once again began performing Kaparot specifically with chickens. He has also ruled this way for his relatives that it is indeed preferable to perform the Kaparot custom using chickens. Therefore, one who has the ability to perform Kaparot using chickens and then have their monetary value donated to charity should indeed do so for the benefit of his soul.

We need not mention the great sin of causing pain to animals, as some are of the opinion in the Gemara (Baba Metzia 32a, Shabbat 154a, and see Shulchan Aruch Choshen Mishpat Chapter 272) that "causing pain to animals is a Torah prohibition." This is a severe sin which also causes one to bring Heavenly prosecution upon himself. Thus, one must be extremely careful to treat the chickens properly so that no unnecessary pain or death befalls them. Thus, one should only perform the custom in this way when it takes place under proper supervision so that the ritual slaughter is also performed in accordance with Halacha and that the same chicken is not used for several people like some swindlers do. If it is not possible to perform this custom in a correct fashion, there is no doubt that one should use money instead of chickens. May our benevolent Hashem forgive us; whether one does a little bit more or a little bit less, it is the same, as long as one does it for the sake of Heaven

High Holy Days

Dear Ladies,

We hope this letter finds you well and in good health.

As we know tefila, prayer, is our strongest tool in connecting directly to Hashem and especially during the upcoming awe-inspiring days of Rosh Hashanah and Yom Kippur, now only a few days away. It is vitally important that we use our tefilot to ask Hashem to inscribe each and every one of us in the Book of Life and that all may merit a year of health and happiness.

The Shulhan Aruch expresses the importance of makom kabua, makon kodesh – that a person’s regular and fixed place where he or she prays has a direct relationship to the power of the tefila, to the extent that the place a person prays is called kodesh – holy.

Therefore, in order to avoid disappointment on such special days we are willing to reserve a seat for lady members of our community.

We will attempt, to the best of our ability, to allocate the seats according to where the ladies sit throughout the year, but we cannot guarantee how the seats will be allocated. We will also consider accommodating places for unmarried girls over Bat Mitzva to sit next to or close to their mothers.

Nitzavim

  1. What is the connection between the verse "atem nitzavim" and the curses in the previous parsha?
    29:12 – The Jewish People asked, "Who can survive such curses?" Moshe responded, "You’ve done a lot to anger Hashem, and yet "atem nitzavim" you’re still standing before Him."
  2. Who were the wood-choppers and water-carriers?
    29:10 – Canaanites who joined the Jewish People under false pretenses.
  3. Why can Hashem never "swap" the Jewish people for another nation?
    29:12 – Because Hashem swore to their ancestors that He would never do so.

"אשרי העם יודעי תרועה"

מובא במדרש רבה (פר’ אמור פר’ כט אות ד), על הפסוק "אשר העם יודעי תרועה", אמר רבי יאשיה, וכי אין אומות העולם יודעים להריע? כמה קרנות יש להם, כמה חצוצרות יש להם? אלא, "העם יודעי תרועה", אלו ישראל, שהם יודעים ומכירים לרצות את בוראם בתרועה. והוא עומד מכסא דין ויושב על כסא רחמים, ומתמלא ברחמים על עמו ישראל. וזהו שנאמר "אשר העם יודעי תרועה", כלומר, מכירים ויודעים את סגולתה ומעלתה וישובו אל ה’.

וסיפר הגאון רבינו עזרא עטיה זצ"ל, ראש ישיבת פורת יוסף, כי הגאון רבי שלמה לניאדו, בעל שו"ת בית דינו של שלמה, שהיה רבה של חלב, היא ארם צובא, היה נוהג בראש השנה לעבור לפני התיבה כשליח צבור, כי ניחון בקול ערב, נעים זמירות ישראל, וגם היה תוקע בשופר. וכן היה נוהג מידי שנה בשנה. כשהגיע הרב לזקנה ושיבה, הודיע לפרנסי הקהל שבאו לביתו לבקרו בשבת שלפני ראש השנה, שנבצר ממנו השנה להיות שליח צבור ותוקע, מפני מצב בריאותו. נענו הפרנסים ואמרו, אולי יואיל רבינו לומר לבנו הגאון רבי אפרים (בעל שו"ת דגל מחנה אפרים) שהוא יעבור לפני התיבה ויתקע בשופר. כששמע כן בנו רבי אפרים, בא לפני מר אביו ואמר לו, אבא, אני מוכן למלא את מקומך השנה, נענה הגאון לדבריו ובירך אותו בהצלחה. וכן היה.

בראש השנה הלך רבי אפרים לבית הכנסת, ועבר לפני התיבה, וכשעמד לתקוע, נתבלבל קצת בתקיעות ותיכף ומיד תיקן כדת. ובבוא ראשי הקהל אל הרב בעל בית דינו של שלמה, לבקרו לנשק ידיו כנהוג, שאל אותם, איך היו התפילות, השיבו בשבח התפלות הנפלאות שהתפלל רבי אפרים כשליח צבור. ושאל, איך היו התקיעות, ועל זה השיבו בשפה רפה, והרגיש שלא היו תקינות כל כך. תיכף ומיד קרא לרבי אפרים, ושאלו על כך, השיבו רבי אפרים, כי היה קורא "יהי רצון" שלפני התקיעות, ואמר "ושלח מלאכיך הקדושים הממונים על התקיעות", והנה תיכף ראה שבא המלאך הממונה על ידו, ויעף אליו אחד מן השרפים והתייצב לימינו, לזאת היה חרד מפניו ונתבלבל. שחק בעל הבית דינו של שלמה, ואמר לו, הנה אתה הזמנת אותו ותירא מפניו. ועל כגון זה נאמר, אשר העם יודעי תרועה.

אכן לנו הדלים, לפחות נכוין לשוב בתשובה, וכמו שאמרו במדרש תהלים, "תקעו בחודש שופר", חדשו ושפרו מעשיכם על ידי השופר. כי השופר, רומז גם על השופר שבזמן מתן תורה, כמו שכתוב בו "ויהי קול השופר הולך וחזק מאד", ולכן אסור להשיח (לדבר) בשעת תקיעות השופר, כי על אותה שעה כתוב במדרש (פר’ יתרו סוף פר’ כט), שהיה כל העולם שקט, חמור לא נער, סוס לא צנף, צפור לא צפצף, מלאכים לא עפו, שרפים לא אמרו קדוש, וקול השופר נשמע מסוף העולם ועד סופו. ולכן אין להשיח או להשתעל ברצון, וצריך לשבת דומיה בעת התקיעות לקיים מצות עשה לשמוע קול שופר. קחו עמכם דברים ושובו אל ה’, אשרי העם יודעי תרועה ומכירים בה לשוב בתשובה

“Fortunate is the Nation which knows the Shofar Blasts”

The Midrash Rabba (Parashat Emor Chapter 29, Section 4) states regarding the verse, “Fortunate is the nation which knows the Shofar blasts”: “Rabbi Yoshiya said: ‘Do the nations of the world not know how to blow? They have so many horns and so many trumpets! Rather, ‘The nation which knows the Shofar blasts,’ refers to the Jewish nation which knows how to appease their G-d with Shofar blasts. He (Hashem) then arises from the throne of judgment and sits on the throne of mercy and becomes filled with compassion for the Jewish nation.’” This is what is meant by the verse, “Fortunate is the nation which knows the Shofar blasts,” meaning the people who know the auspicious meaning and importance of the Shofar blasts and use them to return to Hashem.

Hagaon Harav Ezra Attiazt”l, late Rosh Yeshiva of Porat Yosef, recounts how Hagaon Harav Shlomo Laniado zt”l, author of the Responsa Bet Dino Shel Shlomo and Chief Rabbi of Aleppo, Syria, would serve as Chazzan on Rosh Hashanah since he was blessed with a pleasant and melodious voice in addition to serving as the Shofar blower. He would customarily do so every year. When the rabbi grew older though, he notified the respected community activists that came to visit his home on the Shabbat preceding Rosh Hashanah that due to the current status of his health, he would be unable to serve as Chazzan and Shofar blower during the coming Rosh Hashanah. The community activists replied by asking if the rabbi would request that his son, Hagaon Harav Efraim (author of Responsa Degel Machaneh Efraim), serve as the Chazzan and Shofar blower instead. When his son, Harav Efraim, heard of this, he came before his father and told him that he agreed to fill his father’s place this year. His father gave him his blessing and so it came to be.

On Rosh Hashanah, Harav Efraim went to the synagogue and served as Chazzan but when he began to blow the Shofar, he erred slightly in the order of blasts, but immediately corrected himself as prescribed by Halacha. Upon arriving at the home of his father, Harav Shlomo, in order to visit him and kiss his hand as was customary, the leaders of the community were asked how the prayer services went to which they replied that the services conducted by Harav Efraim were truly amazing. When asked how the Shofar blowing went, they replied half-heartedly and the rabbi understood that it did not go so well. He immediately summoned his son, Harav Efraim, and inquired about this matter. His son replied, “While reciting the ‘Yehi Ratzon’ text prior to the Shofar blowing, I said, ‘Send [me] your holy angels who are appointed over the Shofar blasts.’ I immediately saw one of the fiery angels fly towards me and stand on my right side! I became frightened and this caused me to become confused.” His father then chuckled and told him, “You invited him and then you were afraid of him?!” About such an incident does the verse state, “Fortunate is the nation which knows the Shofar blasts!”

However, regarding us ordinary people, we should, at the very least, have in mind to repent, as the Midrash Tehillim states regarding the verse, “Blow the Shofar on the [new] month”: “Renew and better your deeds through the Shofar.” The Shofar represents the Shofar that was blown during the giving of the Torah, as the verse states, “And the sound of the Shofar became [progressively] much stronger.” Thus, one may not converse during the blowing of the Shofar, for regarding this time, the Midrash (Parashat Yitro, end of Chapter 29) states, “The entire world was silent; no horses neighed, no donkeys brayed, no birds chirped, no angles flew, no fiery angels recited ‘Kadosh,’ and the sound of the Shofar could be heard from one end of the world to the other.” Therefore, one should not speak or cough willingly; one should sit silently during the Shofar blowing and have in mind to fulfill the positive Torah commandment to hear the sound of the Shofar. Take these words with you and use them to return to Hashem while utilizing the sound of the Shofar for this purpose

תקיעת שופר

מצות עשה מן התורה לשמוע תרועת השופר ביום ראש השנה, שנאמר "יום תרועה יהיה לכם". ואסור לדבר בין התקיעות, וכל שכן בזמן התקיעות עצמם, ונחלקו הפוסקים אם יש לומר וידוי בין התקיעות, (כפי שמודפס בהרבה מחזורים.) או שאסור לומר וידוי בין התקיעות, ודעת מרן הרב עובדיה יוסף שליט"א, שאסור לומר וידוי בין התקיעות, ושאף מי שנהג כן, צריך לבטל מנהגו, שנכנס לחשש ברכה לבטלה, ולספק אם חייב לחזור שוב ולברך על התקיעות, ומכל מקום, אם רוצה להרהר הוידוי בליבו בלבד, רשאי לעשות כן בין התקיעות, אבל בשעת התקיעות עצמם ידום ויקשיב היטב לקול השופר.

נשים פטורות ממצות שופר, שהרי היא מצות עשה שהזמן גרמא, וכל מצוות עשה שהזמן גרמן נשים פטורות, כמו שביארנו בכמה הזדמנויות. ומכל מקום נהגו הנשים להחמיר על עצמן ולבוא לבית הכנסת לשמוע תקיעת שופר, ואשה שלא היה באפשרותה לבוא לבית הכנסת, יכולה לשמוע תקיעת שופר בבית, (או בבית הכנסת בשעות הצהריים כפי שמקובל בכמה מקומות). ואין לברך על תקיעת שופר כשתוקע עבור נשים, משום שנשים אינם מברכות על מצות עשה שהזמן גרמא. ויש נשים מעדות אשכנז שנוהגות לברך לעצמן על תקיעת שופר, ויש להן על מה שיסמוכו. ומכל מקום אין לתוקע עצמו לברך עבור נשים גם למנהג זה.

כל היום כשר למצות שופר, מהנץ החמה ועד לשקיעתה, ולכן הבא לתקוע לנשים, רשאי לתקוע כל היום כולו עד שקיעת החמה.

כלל גדול בידינו, כי מצות צריכות כוונה, וכפי שביארנו בהלכה מיוחדת. ועל כן, השומע קול שופר בראש השנה, צריך שישים לבו, לכוין שבשמיעת קול השופר הוא מקיים את מצות השופר

Blowing the Shofar on Rosh Hashanah

It is a positive Torah commandment to hear the Shofar blasts on the day of Rosh Hashanah, as the verse states, “It shall be a day of [Shofar] blasts for you.” One may not speak between the various sets of Shofar blasts and certainly not during the blasts themselves. The Poskim disagree regarding whether or not it is permissible to recite the order of confession (which is printed in most Rosh Hashanah prayer books). Maran Harav Ovadia Yosef Shlit”a rules that one may not recite this confessional between the sets of the Shofar blasts, for this causes one to enter the realm of a blessing in vain and it is doubtful whether or not one must recite the blessing on the Shofar blasts again; even if one has customarily recited this confessional prayer in the past, one must discontinue this custom at once. Nevertheless, if one would like to read this confessional prayer with his eyes only and ponder it in his heart, this is indeed permissible between the sets of blasts; however, during the time the Shofar blasts are actually being sounded, one must sit silently and listen to the Shofar blasts carefully.

Women are exempt from hearing the Shofar blasts since this is positive, time-bound Mitzvah and women are exempt from such Mitzvot as we have discussed on several occasions. Nevertheless, it is customary that women act stringently and come to the synagogue to hear the Shofar blasts. If a woman did not have the opportunity to come to the synagogue may indeed hear the Shofar blasts at home (or later on in the synagogue during the afternoon hours of Rosh Hashanah, as has become the prevalent custom in many synagogues). When one blows the Shofar for women, one may not recite the “Lishmo’a Kol Shofar” blessing since women are exempt from such positive, time-bound Mitzvot. There are some Ashkenazi women who customarily recite the blessing on the Shofar for themselves and they indeed have on whom to rely. Nonetheless, the one blowing the Shofar should not recite a blessing when blowing for women, even according to this view.

The Mitzvah of hearing Shofar blasts may be fulfilled the entire day of Rosh Hashanah, from sunrise until sunset. Therefore, if one would like to blow the Shofar for women, he may do so all day, until sunset.

We have a great rule that “Mitzvot require intention”, as we have discussed in a special Halacha. Thus, before hearing the Shofar blasts on Rosh Hashanah, one must pay attention and have in mind to fulfill the positive Torah commandment of hearing the Shofar blasts when hearing the Shofar
