Although Moshe is content that Yehoshua will lead the nation, Moshe nevertheless prays to enter the Land of Israel in order to fulfill its special mitzvahs. Hashem refuses. Moshe reminds the Jewish People of the gathering at Mount Sinai when they received the Torah, that they saw no visual representation of the Divine, but only the sound of words. Moshe impresses on the Jewish People that the Mount Sinai revelation took place before an entire nation, not to a select elite, and that only the Jewish People will ever claim that Hashem spoke to their entire nation. Moshe specifically enjoins the Bnei Yisrael to “pass over” the Mount Sinai event to their children throughout all generations.
Moshe predicts, accurately, that when the Jewish People dwell in Eretz Yisrael, they will sin and be scattered among all the nations. They will stay few in number — but will eventually return to Hashem.
Moshe designates three “refuge cities” to which an inadvertent killer may flee. Moshe repeats the Ten Commandments and then teaches the Shema, the central credo of Judaism, that there is only One G-d. Moshe warns the people not to succumb to materialism, forgetting their purpose as a spiritual nation. The Torah portion concludes with Moshe exhorting Bnei Yisrael not to intermarry when they enter Eretz Yisrael, as they cannot be a treasured and holy nation if they intermarry, and that in doing so they would become indistinguishable from the other nations.

נהגו לשבת על הקרקע בסעודה המפסקת, וראוי שלא לשבת על הקרקע ממש, משום שיש אומרים שעל פי דברי המקובלים אין לנהוג כן, אלא ישב על הקרקע ויניח תחתיו שמיכה או שטיח, ולא ישבו שלושה אנשים ביחד בסעודה המפסקת, כדי שלא יתחייבו בזימון, אלא ישבו כל אחד במקום אחר.
ומרן זצ”ל היה יושב בסעודה מפסקת על הקרקע לבדו, ודומה כמי שמתו מוטל לפניו.

The Laws of Erev Tisha Be’av
Taking a Stroll
The Sefer Ha’Minhagim, authored by Rabbeinu Eizik Tirna, states that one should not leisurely stroll around on Erev Tisha Be’av. The Rama, some great Acharonim, and seemingly Maran Ha’Chida as well, rule accordingly.
The Last Meal Before the Fast
On Erev Tisha Be’av during the “Seuda Ha’Mafseket,” the last meal before the fast (which takes place following halachic midday, as we shall discuss), our Sages prohibited eating meat and drinking wine. It is customary to prohibit eating fish and drinking beer or other alcoholic beverages during this meal as well. If one usually drinks a small amount of an alcoholic beverage after one’s meal in order to aid in the digestion of the food (such as whiskey), if one wishes to do so following the last meal before the fast, one has on whom to rely.
Two Cooked Foods
Our Sages also prohibited eating two cooked foods during the last meal before the fast of Tisha Be’av. Even two eggs, one soft-boiled and one hard-boiled, are considered to be two cooked foods in this context. Nevertheless, if two foods were cooked in one pot in a way that is common during the rest of the year, such as a vegetable soup, peppers stuffed with rice, and the like, they are considered to be only one cooked food and they may be eaten during this meal. Similarly, our Sages prohibited only two “cooked” foods as opposed to baked goods, such as bread, which are not considered “cooked” foods in this context. Additionally, one may eat several kinds of fruits and vegetables during this meal. However, if the fruits or vegetables were cooked, they may not be eaten.
Some Customs Related to the Last Meal Before the Fast
Some customarily eat bread with ashes (made from burnt paper and the like) during the last meal before Tisha Be’av. Our Sages tell us (Ta’anit 30a) that during this meal, Rabbi Yehuda bar Il’ai would eat dry bread dipped in salt and drink a pitcher of water while seated between the oven and the furnace (the gloomiest place in the house) as though his deceased relative lay before him.
It is customary to eat the “Seuda Ha’Mafseket” while seated on the floor. Nevertheless, one should not sit directly on the floor; rather, one should sit on a blanket or carpet. This is recommended by some Mekubalim. Similarly, three men should not sit and eat together so that they do not become obligated in “Zimmun.” Rather, everyone should sit and eat separately.
Maran zt”l would sit alone on the floor as he ate the “Seuda Ha’Mafseket” and his demeanor was as though he was sitting next to a deceased relative.
Everything we have mentioned above only applies to a meal eaten after halachic midday of Erev Tisha Be’av and only if this meal is the last meal before the fast of Tisha Be’av. However, if one plans to eat another meal after this one, although this current meal is being eaten past halachic midday, it is not considered the “Seuda Ha’Mafseket.” Similarly, if this meal is eaten before halachic midday, although one does not intend to eat another meal before the fast, it is not halachically considered to be the “Seuda Ha’Mafseket” (meaning that the above laws do not apply to it).
Important Note: Nevertheless, what many people commonly do on Erev Tisha Be’av is eat a full meal with many different cooked dishes close to the fast and afterwards sit on the floor to eat an egg and then recite Birkat Hamazon or first recite Birkat Hamazon and then wash again for bread, sit on the floor, and eat some bread and an egg after which they proceed to the synagogue for Tisha Be’av prayers. This is an error and is forbidden according to Halacha, for the Poskim tell us that when we say that as long as one intends to eat another meal before the fast, the previous meal is not considered the Seuda Ha’Mafseket, this only applies when one plans to have an established meal afterwards; however, if one knows the meal one is eating currently is the last actual meal one is having before the fast and only intends to eat an egg or another light snack for ceremonial purposes only and not because one is actually hungry, the previous established meal will retain the Seuda Ha’Mafseket status and it will have been forbidden to eat two cooked foods during that meal. Therefore, the correct procedure is to eat the last established meal (even with several cooked foods) before halachic midday, before going to pray early Mincha, or at least early enough in the day and leave some room so that one will become hungry again closer to the evening so that one may eat another established meal with appetite; this later meal will then be considered the proper Seuda Ha’Mafseket where one may eat only one cooked food and it will have been permissible to eat several cooked foods during the previous meal.

This Parsha begins the last of the Five Books of The Torah, Sefer Devarim. This Book is also called Mishneh Torah, “Repetition of the Torah” (hence the Greek/English title Deuteronomy). Sefer Devarim relates what Moshe told Bnei Yisrael during the last five weeks of his life, as they prepared to cross the Jordan into Eretz Yisrael. Moshe reviews the mitzvot, stressing the change of lifestyle they are about to undergo: from the supernatural existence of the desert under Moshes guidance to the apparently natural life they will experience under Yehoshuas leadership in the Land.
The central theme this week is the sin of the spies, the meraglim. The Parsha opens with Moshe alluding to the sins of the previous generation who died in the desert. He describes what would have happened if they hadnt sinned by sending spies into Eretz Yisrael. Hashem would have given them without a fight all the land from the Mediterranean to the Euphrates, including the lands of Ammon, Moav and Edom. He details the subtle sins that culminate in the sin of the spies, and reviews at length this incident and its results. The entire generation would die in the desert; Moshe would not enter Eretz Yisrael. He reminds them that their immediate reaction to Hashems decree was to want to “go up and fight” to redress the sin. He recounts how they wouldnt listen when he told them not to go, that they no longer merited vanquishing their enemies miraculously. They ignored him and suffered a massive defeat. They were not allowed to fight with the kingdoms of Esav, Moav or Ammon these lands were not to be part of the map of Eretz Yisrael in the meantime. When the conquest of Canaan will begin with Sichon and Og, it will be via natural warfare.

נוהגים קצת מנהגי אבלות, וכמו שהזכרנו בהלכות הקודמות, מכל מקום משנכנס חודש אב,
ועד לאחר עשירי באב, יש מנהגי אבלות נוספים שיש לנהוג בהם, מפני שבחודש אב אירע
החורבן, ואמרו חז”ל, שימים אלו הם ימי פורענות לישראל, ומזלם אינו מאיר להם
בימים אלו. וכך שנינו במסכת תענית (דף כו:) “משנכנס אב ממעטין בשמחה“. ולכן ישראל שיש לו דין ודברים ותביעה משפטית עם גוי,
יתחמק מלהתדיין עמו בימים אלו, ויתדיין עמו לאחר עשירי באב.
משא ומתן של שמחה
מיום ראש חודש אב, ממעטין במשא
ומתן של שמחה, כגון קניית רהיטים חדשים לבית חתן וכלה, או
קניית תכשיטי זהב וכסף, וכיוצא בזה. ובשאר משא ומתן שאינו של שמחה, כגון קניית
רהיטים לביתו, או מכונית חדשה וכדומה, אף על פי שהיה ראוי להחמיר בזה, מכל מקום
נהגו להקל. וכתב מרן רבינו עובדיה יוסף זצוק”ל, שמכל מקום טוב להמנע מלהביא
רהיטים חדשים לביתו, או מכונית חדשה לביתו, בימים אלו, משום ששמחה היא לו.
אכילת בשר ושתיית יין
נהגו ישראל, שבימים אלו, מיום ראש
חודש אב ועד ליום עשירי באב, הקרויים “תשעת הימים”, אינם שותים יין ולא
אוכלים בשר, אלא ביום השבת. (ובענין זה נדון בהלכה
הבאה). וביום ראש חודש אב עצמו,
מותר לאכול בשר ולשתות יין, שכבר
כתב מרן רבינו הגדול רבי עובדיה יוסף זצ”ל, שלא נהגו איסור באכילת בשר אלא
מאחר ראש חודש אב, כלומר, מיום ראשון הבא עלינו לטובה. אולם למנהג האשכנזים יש
להחמיר בזה אפילו ביום ראש חודש עצמו. (חזון עובדיה עמוד קסט).
שבוע שחל בו תשעה באב
ובשבוע שחל בו תשעה באב, נוהגים
עוד מנהגי אבלות, ובכללם האיסור לרחוץ כל גופו במים חמים (אבל במים צוננים מותר
לרחוץ כל גופו), וכן אסור לכבס בגדים או ללבוש בגדים מכובסים. ובשנה זו
(תשע”ה) יחול יום תשעה באב בשבת, ולכן הדין בשנה זו
שונה, שהרי אין לנו בכלל שבוע שחל בו תשעה באב. (חזון עובדיה עמוד רכג).
החומרות שנהגו בהם האשכנזים
מנהג האשכנזים להחמיר מאד באיסור
הרחיצה, ולמנהגם יש לאסור את הרחיצה מיום ראש חודש
אב, בין במים חמים בין במים צוננים, (זאת אומרת שהם נוהגים שתי חומרות נוספות,
לאסור רחיצה כבר מיום ראש חודש אב ולאסור רחיצה אף במים קרים). אולם אף למנהג
האשכנזים, אם מדובר באדם הגר במקום שהאקלים שם חם, כגון בארץ ישראל, או באדם המזיע
הרבה מחמת איזו סיבה, מותר לו לרחוץ כל גופו במים שאינם חמים אף בשבוע שחל בו תשעה
באב. כי לא קיבלו עליהם האשכנזים חומרות אלו, אלא בארצותיהם, שהם ארצות קרות,
וגדול כבוד הבריות, ולכן יש להקל בזה כאמור. וכן פסק גם הגאון רבי משה פיינשטיין
זצ”ל.
כמו כן נוהגים האשכנזים להחמיר בענין כיבוס
ולבישת בגדים מכובסים, שהספרדים נוהגים בזה רק בשבוע שחל בו תשעה באב, ואילו
האשכנזים נוהגים איסור בדבר החל מיום ראש חודש אב.
קניות עבר חתן וכלה
כתב מרן רבינו עובדיה יוסף
זצ”ל, שאם קבעו את זמן הנשואים מיד לאחר תשעה באב, והבחור עדיין לא קיים פריה
ורביה (דהיינו שעדיין אין לו בן ובת), מותר לקנות עבור החתן והכלה כל צרכיהם אפילו
בימים אלו, ואפילו אם יש זמן לקנות את צרכי החתן והכלה אחרי תשעה באב, כגון
שנשואיהם נקבעו ליום ט”ו באב, אם יש חשש שיתייקרו לאחר מכן, מותר לקנותם
בימים אלו כל שיש חשש הפסד בדבר.
ולסיכום הדברים: ישנם ארבעה דרגות
חומרה של אבלות בימים אלו. הדרגה הקלה מיום שבעה עשר בתמוז ועד ראש חודש אב. הדרגה
השנייה מיום ראש חודש אב ועד עשירי באב.

When Av Begins, We Reduce Our Joy

Let us begin to discuss the laws of the
month of Av.
The Jewish Nation’s Fortune during the Month of Av
Although we customarily implement some mourning customs during the entire
“Three Weeks” as we have mentioned in previous Halachot, when the month
of Av begins until following the tenth of Av, additional customs of mourning
are implemented, for the destruction of the Bet Hamikdash occurred during the
month of Av. Our Sages say that these days are troublesome for the Jewish
nation and their fortune does not shine during this time. Indeed, the Gemara in
Masechet Ta’anit (26b) tells us, “When Av begins, we reduce our joy.” Thus, if
a Jew has a pending court-case with a non-Jew, he should try to avoid having it
during this time and should try to postpone it for after the Tenth of Av.
Joyous Transactions
From the day of Rosh Chodesh Av, we abstain from performing joyous
transactions, such as purchasing furniture for a new bride and groom,
purchasing gold and silver jewelry, and the like. Regarding other transactions
that are not linked to any particular joy, such as purchasing furniture for
one’s home, purchasing a new car, and the like, although it seems appropriate
to act stringently and abstain from doing so, nevertheless, the custom is
indeed to be lenient. It is preferable that one not bring new furniture or a
new car to one’s home during these days, for this causes one to be happy.
Eating Meat and Drinking Wine
The prevalent custom among the Jewish nation is that during the “Nine Days,”
which is the period between Rosh Chodesh Av until the Tenth of Av, we abstain
from eating meat and drinking wine besides for on Shabbat (we shall, G-d
willing, discuss this detail in depth in a following Halacha). On Rosh
Chodesh Av, one is still permitted to eat meat and drink wine, for Maran
Rabbeinu Ovadia Yosef zt”l writes that it is only customarily prohibited
from the day following Rosh Chodesh Av, the Second of Av. Nevertheless, the
Ashkenazi custom is to act stringently and refrain from eating meat and
drinking wine beginning from the day of Rosh Chodesh itself. (Chazon
Ovadia-Arba Ta’aniyot, page 169)
The Week during which Tisha Be’av Falls Out
Additional mourning customs are observed during the week during which Tisha
Be’av falls out, including the prohibitions to wash one’s body with hot water,
launder clothing, and wear freshly-laundered clothes. Nevertheless, this year
when Tisha Be’av coincides with Shabbat, the laws of the week during which
Tisha Be’av falls out do not apply at all according to the Sephardic custom
(Chazon Ovadia-ibid, page 223).
The Stringencies Observed by Ashkenazim During This
Period
Nevertheless, the Ashkenazi custom is to prohibit washing one’s body from Rosh
Chodesh Av with either hot or cold water (which means that they customarily
observe two stringencies: the first being the prohibition of washing as early
as Rosh Chodesh Av and the second being that they even prohibit washing one’s
body with cold water as well). Nevertheless, even according to the Ashkenazi
custom, if one lives in a place where the climate is hot, such as in Israel, or
if one sweats profusely for whatever reason, one may wash his body with water
that is not hot even during the week during which Tisha Be’av falls out. The
reason for this is because the Ashkenazim only accepted these stringencies upon
themselves in their countries, which had cooler climates; this is especially
true since personal hygiene is very important. Thus, one may be lenient
regarding this matter when necessary, as we have explained above. Hagaon Harav
Moshe Feinstein zt”l rules accordingly.
The same applies to the laws of laundering and wearing
freshly-laundered clothing in that the Sephardic custom is to abstain from
these things only during the week during which Tisha Be’av falls out.
Ashkenazim, however, customarily abstain from these things beginning from Rosh
Chodesh Av.
Purchasing Items for a Bride and Groom
Maran Rabbeinu Ovadia Yosef zt”l writes that if a wedding date was set
for immediately following Tisha Be’av and the groom has not yet fulfilled the
Mitzvah of “being fruitful and multiplying” (meaning that he did not yet father
children), all of the necessities of the bride and groom may be purchased
during these days. Even if one has the opportunity to purchase these items
after Tisha Be’av, for instance if the wedding is on the Fifteenth of Av, if
one is concerned that the price of the items may rise in the meantime, these
items may indeed be purchased during these days, as long as there is due
concern for monetary loss.
Summary: There
are four levels of varying severity regarding the mourning customs observed
during these days. The lowest level is from the Seventeenth of Tammuz until
Rosh Chodesh Av. The second level is from Rosh Chodesh Av until the Tenth of
Av. The third level, which is more stringent than the former, is during the
week during which Tisha Be’av falls out. The fourth level, most stringent of
all, is the day of Tisha Be’av itself, which is a day of mourning and fasting,
as we shall discuss

Matot
Moshe teaches the rules and restrictions governing oaths and vows, especially the role of a husband or father in either upholding or annulling a vow. The Bnei Yisrael wage war against Midian. They kill the five Midianite kings, all the males and Bilaam. Moshe is upset that women were taken captive. They were catalysts for the immoral behavior of the Jewish People. He rebukes the officers. The spoils of war are counted and apportioned. The commanding officers report to Moshe that there was not even one casualty among the Bnei Yisrael. They bring an offering that is taken by Moshe and Elazar and placed in the Ohel Mo'ed (Tent of Meeting). The Tribes of Gad and Reuven, who own large quantities of livestock, petition Moshe to allow them to remain on the eastern side of the Jordan River and not enter the western Land of Israel. They explain that the land east of the Jordan is quite suitable grazing land for their livestock. Moshe's initial response is that this request will discourage the rest of the Bnei Yisrael, and that it is akin to the sin of the spies. They assure Moshe that they will first help conquer the Land of Israel, and only then will they go back to their homes on the eastern side of the Jordan River. Moshe grants their request on condition that they uphold their part of the deal.
Masei
The Torah names all 42 encampments of the Bnei Yisrael on their 40-year journey from the Exodus to the crossing of the Jordan River into Eretz Yisrael. Hashem commands the Bnei Yisrael to drive out the Canaanites from the Land of Israel and to demolish every vestige of their idolatry. The Bnei Yisrael are warned that if they fail to completely rid the Land of the Canaanites, those who remain will be “pins in their eyes and thorns in their sides.” The boundaries of the Land of Israel are defined, and the tribes are commanded to set aside 48 cities for the Levites, who do not receive a regular portion in the division of the Land. Cities of refuge are to be established so that someone who unintentionally kills another person may flee there. The daughters of Tzlofchad marry members of their own tribe so that their inheritance will stay in their own tribe. Thus ends the Book of Bamidbar/Numbers, the fourth of the Books of the Torah.
תספורת בימי בין המצרים – שנת תשפ”ו
אולם הספרדים ובני עדות המזרח לא נהגו להחמיר בזה, אלא מנהגינו כעיקר תקנת רבותינו התנאים, שגזרו אחר חורבן בית המקדש, שבשבוע שחל בו תשעה באב, אסור מלספר ולכבס, וכן פסקו הרמב”ם ומרן השלחן ערוך. אולם אלה מהספרדים שלומדים או גרים בסביבת אשכנזים, ורוצים להחמיר בזה, רשאים להחמיר. (כמו שכתב בספר חזון עובדיה ארבע תעניות).
ושבוע שחל בו תשעה באב, פירושו, השבוע שבתוכו חלה תענית תשעה באב, מיום ראשון ואילך. ולדוגמא השנה, שיחול יום תשעה באב ביום חמישי (עוד כמעט שלושה שבועות), הרי שמיום ראשון שלפניו, נוהגים כל מנהגי האבלות השייכים לשבוע שחל בו תשעה באב.
נחלקו הפוסקים, לענין אשה שאבלה על אחד משבעת קרוביה (אב ואם, אח ואחות, בן ובת, ובעל), האם אסור לה להסתפר, כשם שלאנשים אסור להסתפר, או שאיסור זה אינו נוהג באשה.
ולהלכה, מרן השלחן ערוך, אשר הספרדים וכל בני עדות המזרח הולכים לאורו, פסק שאין איסור תספורת נוהג באשה. ועל כן תיכף אחר שבעת ימי האבל, מותר לאשה להסתפר. אבל הרמ”א, שלפי הוראותיו הולכים האשכנזים היוצאים ביד רמ”א, פסק שאיסור תספורת נוהג גם בנשים.
ולפי זה נראה, שלדעת מרן השלחן ערוך, ולמנהג הספרדים, אין איסור תספורת נוהג בנשים גם בשבוע שחל בו תשעה באב. אבל למנהג האשכנזים היוצאים ביד רמ”א, אף הנשים בכלל איסור זה. וכן פסק הגאון רבי משה פיינשטיין זצ”ל, ועוד מגדולי הפוסקים.
ומכל מקום יש מרבני האשכנזים שכתבו, שאף על פי שבאבלות ממש, מנהגם הוא שגם הנשים אינן מסתפרות, מכל מקום בבין המצרים רשאיות הנשים להקל בזה, כי אין תוקף מנהג האבלות חמור כל כך מצד הדין, רק בתורת מנהג, כמו שביארנו. אבל בשבוע שחל בו תשעה באב, שאז איסור התספורת הוא מתקנת חכמי המשנה ממש, ולא רק מחמת המנהג, אין לחלק בין אנשים לנשים.
ולמעשה: מנהג האשכנזים לאסור תספורת בכל ימי בין המצרים. והספרדים מחמירים בזה רק בשבוע שחל בו תשעה באב, ולגבי נשים, אף מן האשכנזים המיקלות בזה, יש להן על מה לסמוך
The Laws of Taking Haircuts During the “Three Weeks”- The Year 5786
The Customary Prohibition of Haircuts
As a result of the mourning observed during the “Three Weeks,” the Ashkenazi custom is to abstain from shaving and taking haircuts beginning from the Seventeenth of Tammuz until the Tenth of Av.
Nevertheless, the Sephardic custom is not as stringent and follows the letter of the law established by a Tannaic enactment (following the destruction of the Bet Hamikdash) which is to prohibit taking haircuts and laundering clothing during the week during which Tisha Be’av falls out. The Rambam and Maran Ha’Shulchan Aruch rule likewise. Those Sephardic Jews who study with or live in close proximity to Ashkenazim may act stringently and abstain from shaving and taking haircuts from the Seventeenth of Tammuz.
The week during which Tisha Be’av falls out refers to the very week the fast of Tisha Be’av is observed, beginning from Sunday of that week. For instance, if Tisha Be’av occurs on Thursday, as it does this year, all of the mourning customs associated with the week during which Tisha Be’av falls out begin from the previous Sunday.
Haircuts for Women
Regarding a woman taking a haircut during the week during which Tisha Be’av falls out or during the “Three Weeks” according to the Ashkenazi custom, this depends on a related disagreement among the Poskim, as follows:
The Poskim disagree regarding whether a woman who is in mourning for one of seven relatives (father, mother, brother, sister, son, daughter, or husband) is forbidden to take a haircut just as it is forbidden for a male mourner or perhaps, this prohibition does not apply to women.
Halachically speaking, Maran Ha’Shulchan Aruch, whose rulings are followed by Sephardic and Middle Eastern Jews, writes that the prohibition to take a haircut does not apply to women. Thus, immediately following the initial seven days of mourning (Shiva), a woman may take a haircut. Nevertheless, the Rama, whose rulings are followed by Ashkenazi Jews, writes that the prohibition to take a haircut applies to women as well.
It therefore seems that according to Maran Ha’Shulchan Aruch and the Sephardic custom, the prohibition to take haircuts observed in mourning the destruction of the Bet Hamikdash does not apply to women either. However, according to the Rama and the Ashkenazi custom, women are also included in this prohibition. Hagaon Harav Moshe Feinstein zt”l and other great Poskim rule likewise.
On the other hand, there are Ashkenazi Poskim who write that although women are prohibited to take haircuts while in actual mourning for a relative, nevertheless, woman may, in fact, act leniently and take haircuts during the “Three Weeks,” for this (not taking haircuts throughout the entire “Three Weeks”) is not as much a halachic prohibition according to the letter of the law as it is a custom which has been accepted. However, during the week during which Tisha Be’av falls out, when it is an actual prohibition to take a haircut based on the edict of the Sages of the Mishnah and not merely customary, there is no distinction between men and women.
Halachically speaking, according to the Ashkenazi custom, men abstain from taking haircuts from the Seventeenth of Tammuz while the Sephardic custom is to permit this until the week during which Tisha Be’av falls out. Regarding women, those who wish to act leniently, even among Ashkenazi women, have on whom to rely.

Hashem tells Moshe to inform Pinchas that he will receive Hashem’s “covenant of peace” in reward for his bold action — executing Zimri and the Midianite princess Kozbi. Hashem commands Moshe to maintain a state of enmity with the Midianites, who lured the Jewish People into sin. Moshe and Elazar are told to count the Jewish People. The Torah lists the names of the families in each tribe. The total number of males eligible to serve in the army is 601,730. Hashem instructs Moshe how to allot the Land of Israel to the Bnei Yisrael. The number of the Levites' families is recorded. Tzlofchad's daughters file a claim with Moshe.
In the absence of a brother, they request their late father's portion in the Land. Moshe asks Hashem for the ruling, and Hashem tells Moshe that their claim is just. The Torah teaches the laws and priorities which determine the order of inheritance. Hashem tells Moshe that he will ascend a mountain and view the Land that the Jewish People will soon enter, although Moshe himself will not enter it. Moshe asks Hashem to designate the subsequent leader, and Hashem selects Yehoshua bin Nun. Moshe ordains Yehoshua as his successor in the presence of the entire nation. This Torah portion concludes with special teachings of the service in the Beit Hamikdash.

ופירשו חז”ל (במסכת ראש השנה דף יח:), צום הרביעי זה צום שבעה עשר בתמוז, כי
חודש תמוז הוא החודש הרביעי מחודש ניסן. (וידוע שחודש ניסן הוא הראשון לחודשי השנה
לפי מנין תורתינו הקדושה). וצום החמישי זה צום תשעה באב, כי חודש אב הוא החודש
החמישי מחודש ניסן. וצום השביעי זה צום גדליה, שהוא בשלושה בתשרי, שהוא החודש
השביעי מחודש ניסן. וצום העשירי זה עשרה בטבת, שהוא החודש העשירי מחודש ניסן.

שרף אפוסטמוס הרשע את התורה, והועמד צלם בהיכל בית המקדש.

הכל
חייבים להתענות ביום שבעה עשר בתמוז, וחיוב התענית הוא מעלות השחר ועד לצאת
הכוכבים. ואף על פי שזמן התענית הוא מעלות השחר, מכל מקום מי שקם משנתו באמצע
הלילה קודם עלות השחר, אסור לו לאכול, אלא אם כן התנה קודם שהלך לישון שבכוונתו
לקום ולאכול.
מי הוא
המחוייב בתענית זו?
קטנים, דהיינו בן פחות משלוש
עשרה שנים, ובת פחותה משתים עשרה שנים, פטורים לגמרי מתעניות אלו. ואינם צריכים
להתענות אפילו כמה שעות. ואפילו אם יש בהם דעת להתאבל על חורבן ירושלים, כל שלא
הגיעו לגיל מצוות, פטורים לגמרי מתעניות אלו, ואפילו אם רוצים להחמיר על עצמם ולהתענות,
יש למחות בידם. ויש מחמירים שלא לתת לקטנים בתענית ציבור אלא לחם ומים. וכן מנהג
כמה מעדות האשכנזים שילדים קטנים שכבר מבינים ענין החורבן, אינם אוכלים אלא לחם
ומים. אבל הספרדים ובני עדות המזרח לא נהגו כן, וכן העיד מרן הרב חיד”א,
שמנהג הספרדים שנותנים לילדים כל צרכם ביום תענית ציבור.
ומעוברות
ומניקות פטורות מלהתענות בשבעה עשר בתמוז, בצום גדליה ובעשרה בטבת. (ולענין תשעה
באב יבואר אי”ה בזמנו). ואפילו אם רוצות להחמיר על עצמן ולהתענות יש למחות
בידן.
ולענין
זה נקראת מעוברת כל שהוכר עוברה, דהיינו שעברו שלושה חודשים מתחילת הריונה. ואם
סובלת ממחושים והקאות פטורה מכל התעניות הללו גם קודם עבור שלושה חודשים מתחילת
הריונה, ובפרט אם עברו כבר ארבעים יום מתחילת הריונה.
ולגבי
מינקת, כלומר, אשה מניקה, שאמרו שפטורה מתעניות אלו. נחלקו הפוסקים, אם רק אשה
שהיא מניקה בפועל פטורה מן התענית, אבל אשה שאינה מניקה בפועל, אף על פי שהיא בתוך
עשרים וארבעה חודשים מזמן לידתה, חייבת להתענות, או שלעולם אין להתחשב בכך שהיא
אינה מניקה בפועל, שכל עשרים וארבעה חודשים מזמן הלידה האשה חלשה מאד, וכמו שאמרו
רבותינו “שאבריה מתפרקין”, ולכן יש לפטרה מן התענית. ומרן הרב
שליט”א, היה מורה ובא במשך שנים להקל בדבר, ושכל אשה תוך עשרים וארבעה חודשים
ללידתה, פטורה מלהתענות בתעניות אלה. וכן כתב בספרו חזון עובדיה העוסק בהלכות
הללו, שכל אשה מינקת פטורה מן התענית, ואפילו אם אינה מניקה בפועל, כל שהיא תוך
עשרים וארבעה חדוש מלידתה, יש לפטרה מן התענית. אולם הוסיף, לאחר שעיין בדבר,
שנכון להקל בזה דוקא באופן שהיא מרגישה בעצמה חולשה יתרה, שאז דינה כדין מינקת,
אבל אם היא אינה חשה תחושה של חולשה יתירה, כגון סחרחורת וכדומה, נכון להחמיר
שתתענה אף היא. וכן פסקו עוד מרבני זמנינו, ובהם הגאון רבי שלום משאש זצ”ל
ועוד. ויש אומרים שכל אשה שהיא תוך עשרים וארבעה חודשים ללידתה, הרי היא פטורה מן
התענית, משום שבדרך כלל היא עסוקה בשאר עניני הבית, ונחלשת מאד מחמת התענית
The Seventeenth of Tammuz
Tomorrow, Thursday, is the
Seventeenth of Tammuz (may Hashem renew it as a joyous and festive day). From
the times of the destruction of the Bet Hamikdash, the Jewish nation began to
fast on this day. This day likewise the “Three Weeks” between the Seventeenth
of Tammuz and the Ninth of Av.
The Fast of the Seventeenth of Tammuz
The prophet Zecharia (8, 19) states: “So says Hashem, G-d of Hosts: The fourth,
fifth, seventh, and tenth fast days shall be for the house of Yehuda for
gladness, joy, and good times; [only] love of truth and peace.” Our Sages (in
Masechet Rosh Hashanah 18b) explain that the “fourth fast day” refers to the
Seventeenth of Tammuz, for Tammuz is the fourth month when counting from Nissan
(Nissan is the first of the months of the year according to our holy Torah).
The “fifth fast day” refers to the fast of the Ninth of Av, for Av is the fifth
month when counting from Nissan. The “seventh fast day” refers to the Fast of
Gedalya which falls out on the third of Tishrei, which is the seventh month
from Nissan. The “tenth fast day” refers to the fast of the Tenth of Tevet,
which is the tenth month from Nissan.
The Essence of the Fast
The Rambam writes that the entire Jewish nation must fast on these days because
of the tragedies that befell them on these days. This will serve to awaken
their hearts and open the pathways to repentance. This will also serve as a
reminder of our evil deeds and the deeds of our ancestors that resembled our
current deeds which eventually caused these tragedies to befall them and us.
Upon remembering these things, we shall mend our ways, as the verse states,
“And they shall confess their sins and the sins of their fathers.”
What Occurred on the Seventeenth of Tammuz?
The following five terrible events occurred on the Seventeenth of Tammuz: The
two tablets bearing the Ten Commandments were broken, the daily Tamid offering
brought in the Bet Hamikdash ceased, our enemies breached the walls of
Jerusalem in the Second Temple era, the wicked Apostemos burnt the Torah, and
an idol was erected in the sanctuary of the Bet Hamikdash.
The Time of the Fast
Everyone is obligated to fast on the Seventeenth of Tammuz, and the fast begins
at dawn and ends at nightfall with the emergence of the stars. Although the
fast begins at dawn, if one wakes up in the middle of the night before dawn,
one may not eat unless one specifically makes a condition before going to sleep
that one has in mind to wake up and eat before the fast begins.
Who Is Obligated to Fast?
Minors, meaning boys under the age of thirteen and girls under the age of
twelve, are completely exempt from these fasts. They need not even fast for
several hours. Even if they have the understanding to mourn over the loss of
the Bet Hamikdash, as long as they have reached Bar/Bat Mitzvah age, they are
completely exempt from these fasts. Even if they wish to act stringently and
fast, one should object to them doing so. Some are stringent to only feed
minors bread and water on public fast days. This is indeed customary among some
Ashkenazi communities who hold that if the child is able to understand the
gravity of the destruction of the Bet Hamikdash, he should only be fed bread
and water. However, Sephardic and Middle Eastern Jews customarily do not rule
this way, as Maran Ha’Chida testifies that the custom among the Sephardim was
to feed their children whatever they needed on public fast days.
Pregnant and nursing women are exempt from fasting on the Seventeenth of
Tammuz, the Fast of Gedalya, and the Tenth of Tevet. (Their law regarding Tisha
Be’av will, G-d willing, be discussed at a later time.) Even if they wish to be
stringent and fast, one should object to them doing so.
Regarding this matter, a pregnant woman is defined as when her pregnancy is
noticeable, meaning when the first trimester of pregnancy has elapsed. However,
if she suffers from aches, pains, vomiting, and the like, she is exempt from
all of these fasts even before three months of pregnancy have elapsed; this is
especially true if forty days from the start of her pregnancy have already
elapsed.

The laws of the Red Heifer – Parah Adumah – are detailed, regarding purification from the defilement of death, i.e., of contact with a corpse.
After nearly 40 years in the desert, Miriam dies and is buried at Kadesh. The people complain about the lack of water which, until now, had been provided miraculously in the merit of Miriam’s righteousness, Hashem commands Moshe and Aharon to gather the nation at Merivah and speak to a designated rock, which will give forth water. Distressed by the people's lack of faith, Moshe hits the rock instead. He thus fails to produce the intended public demonstration of Hashem's mastery, had the rock produced water merely at Moshe's word. Hashem tells Moshe and Aharon that they will therefore not bring the people into the Land.
The Jewish People travel toward Eretz Yisrael, but the King of Edom, a descendant of Esav, denies them passage, so they take a circuitous route. When they reach Mount Hor, Aharon dies and his son Elazar is invested with his priestly garments and responsibilities. Beloved by all, Aharon is mourned by the entire nation. With the loss of Aharon’s protective merit, the “Canaanite” king of Arad attacks and takes a captive, but Hashem hears the Jewish People’s prayers and saves them.
The people become discouraged at their seemingly incessant travels and criticize the mann, whereupon Hashem sends venomous serpents that kill many. When the people repent Moses prays for them, makes a copper serpent at Hashem’s command, and hoists it upon a pole. Those bitten look at it and live.
They finally encamp at the passageway to Eretz Yisrael, where they sing a song praising Hashem, praising Moshe, and praising Hashem’s many miracles, especially the miracle of the well.
The Amorite King, Sichon, attacks Bnei Yisrael when they ask to pass through his land; Bnei Yisrael thereby conquer the lands that Sichon had previously seized from the Amonites on the east bank of the Jordan River.
Balak
Balak, King of Moav, is in morbid fear of the Bnei Yisrael. He summons a renowned sorcerer named Bilaam to curse them. First, G-d speaks to Bilaam and forbids him to go. But, because Bilaam is so insistent, G-d appears to him a second time and permits him to go. While en route, a malach (emissary from G-d) blocks Bilaam's donkey's path. Unable to contain his frustration, Bilaam strikes the donkey each time it stops or tries to detour. Miraculously, the donkey speaks, asking Bilaam why he is hitting her. The malach instructs Bilaam
regarding what he is permitted to say and what he is forbidden to say about the Jewish People. When Bilaam arrives, King Balak makes elaborate preparations, hoping that Bilaam will succeed in the curse. Three times Bilaam attempts to curse, and three times blessings are issued instead. Balak, seeing that Bilaam has failed, sends him home in disgrace. The Bnei Yisrael begin sinning with the Moabite women and worshipping the Moabite idols, and they are punished with a plague. One of the Jewish leaders brazenly brings a Midianite princess into his tent, in full view of Moshe and the people. Pinchas, a grandson of Aharon, grabs a spear and kills both evildoers. This act brings an end to the plague — but not before 24,000 people died.
דין הכאת ילדים
אמרו בגמרא במסכת מועד קטן (דף יז.), ששפחתו של בית רבי (כלומר, שפחה שהייתה עובדת בביתו של רבינו יהודה הנשיא), ראתה אדם אחד שהיה מכה את בנו גדול, כלומר, הוא הכה את בנו, שלא היה ילד קטן כל כך, אמרה, יהיה אותו איש מנודה, משום שעובר על “ולפני עור לא תיתן מכשול”. ופירש רש”י, שכיון שאותו בן לא היה קטן, ואביו מכהו, עלול הוא לבוז ולזלזל באביו, נמצא שאביו מכשילו באיסור. ואמרו שם בגמרא שחכמים לא נהגו קלות ראש בנידוי זה במשך שלוש שנים. כלומר, הסכימו למעשיה של השפחה, שנדתה את אותו אדם.
וכבר הזכרנו פעם בקצרה את דברי הרמב”ם, שאסור לו לאדם להכביד עולו על בניו יותר מדאי, בכדי שלא יכשילם באי קיום מצות כבוד אב ואם. וכל שכן שלא יכה את בניו יותר מדאי, שבכך הוא עלול להכשילם יותר באיסורי תורה. ומרן השלחן ערוך פסק כן להלכה, שאסור לאב להכות את בנו גדול, פן יתריס כנגדו, ויחזיר לו, ונמצא עובר על לפני עור לא תיתן מכשול. ופשוט הדבר, שאין חילוק בזה בין בנו לבתו.
וכתב הרמ”א, שמה שנאמר מכה בנו “גדול”, אין הכוונה בן שלוש עשרה, אלא מגיל עשרים ושתים שנה, שאז עשוי להתריס כנגד אביו. אולם דברי הרמ”א אינם נכונים אלא לפי דורו, שאז היו הילדים מתנהגים בהכנעה רבה בפני הוריהם, אבל בזמנינו שגדלה החוצפה, בלי ספק יש איסור להכות את בנו אף בגיל צעיר יותר, וכמו שכתב הריטב”א, וזו לשונו:
“ונראים הדברים דלא גדול, גדול ממש, אלא הכל לפי טבעו, שיש לחוש שיתריס כנגדו בדיבור או במעשה, ואפילו אינו בר מצוה עדיין, אין ראוי להביאו לידי מכה אביו או מקלל אביו, אלא ישדלנו בדברים”. עד כאן. וכן פסק מרן רבינו הגדול זצוק”ל.
וכתב הרמב”ם, שמלמד תינוקות (כלומר, מלמד ילדים קטנים, שבזמן חז”ל נהגו שהיה מכה את הילדים כדי לחנכם), מכה את התלמידים ברצועה קטנה כדי להטיל עליהם אימה, ואינו רשאי להכותם מכת אויב מכת אכזרי, לכן לא יכה אותם בשוטים או במקלות. וכתב מרן הרב עובדיה יוסף זצ”ל, שבודאי שכן הדין לגבי אביו גם כן, שעליו להתנהג עם בניו בנחת, כרחם אב על בנים.
ובספר פלא יועץ (להגאון רבי אליעזר פאפו שהיה רב בסיליסטא מחוז דוברוג'ה לפני כמאתיים שנה בקירוב) כתב, שאפילו הבן קטן, כל שיודע בו שאינו מקבל מרות, כמו בדורות הללו שגדלה החוצפה, ובן בועט באביו, צריך דעת מיושבת לאב ולאם שלא ידברו אל בניהם אלא בלשון רכה.
וכתב עוד מרן רבינו זצ”ל, שגם כשראוי להכות הקטן לחנכו, כמו שהיה בדורות הקודמים, היה צורך להזהר שלא יכהו בשעת כעסו, שאם יכשל ויכה אותו יותר ממה נכון, מחמת כעסו עליו, והמכה את בנו שלא לצורך גודל עוונו מנשוא, שהרי המרים יד על חבירו נקרא רשע, וגם צריך לנהוג בחכמה שלא לבוא חלילה למצבים קשים, כמו שנמצא בכמה מקרים שהלכו בנים והלשינו למשטרה על הוריהם שמכים אותם וכדי בזיון וקצף.
ומן הראוי לציין, שבדורותינו דעת רוב הרבנים, שאין להכות את הבנים כלל, משום שעל ידי זה נוצר קשר לא בריא ולא חם בין הילדים להוריהם, ויש לכך השלכות כבדות משקל לכל חיי הילדים. והנסיון הוכיח, שהורים שחינכו את בניהם במשטר נוקשה ובלי פשרות, הגיעו בדרך כלל לראות בנים ובנות הסרים מן הדרך ובועטים בכל הקדוש והיקר להוריהם. וזאת מלבד הריחוק הנפשי שיש בין הילדים להוריהם, וחוסר המעורבות של ההורים בחיי הילדים, וכל זאת משום שילד בן דורינו לא יוכל להרגיש הזדהות עם אדם שמחנך אותו בנוקשות. ולעומת זאת, ההולך עם בניו לאט לאט, במתינות ונחת, מתוך סבלנות והבנה, זוכה לקשר חיובי יותר עם הילדים, כך שגם עם התבגרותם יוכל למצוא נתיבות ללבבם להשפיע עליהם בדרך נכונה לעלות במעלות טובות.
על כן כל אחד יזהר לנהוג בחכמה ובתבונה בחינוך בניו ובנותיו, ויתפלל להשם יתברך שינחהו בדרך נכונה לזכות לרוות נחת מבניו ובנותיו, וגם על האם מוטלת החובה להתחנן לפני הקדוש ברוך, שיזכו לגדל בניהם לתורה וליראת ה', וכל רואיהם יכירון כי הם זרע ברך ה'.
The Laws of Striking One’s Children
The Gemara in Masechet Mo’ed Katan (17a) recounts how the maidservant of the household of Rabbi Yehuda Ha’Nassi once saw a man striking his older son and exclaimed that this man should be excommunicated because he had transgressed the prohibition of “Do not place a stumbling-block in front of a blind man.” Rashi explains that since this child being hit by his father was not a youngster, this action would probably cause him to denigrate and humiliate his father, thus, his father was causing him to sin. The Gemara there relates that the Sages did not treat this excommunication lightly for a three year period.
We have already mentioned the words of the Rambam who writes that one should not over-burden his children in order not to cause them to act with a lack of respect towards him. Certainly, one must not hit his children excessively, for by doing so he is creating a bigger chance for them to transgress several Torah prohibitions. Maran Ha’Shulchan Aruch indeed rules likewise that a father may not strike his adult son, lest the son be tempted to hit him back, causing the father to transgress the prohibition of “placing a stumbling-block in front of a blind man.”
The Rama writes regarding hitting one’s “adult” son that this does not refer to the age of thirteen; rather, “adult” refers to the age of twenty-two and over, for this is when a son is tempted to strike back at his father. However, the words of the Rama seem correct only with regards to his generation where children would treat their parents with the utmost respect, but in our generation where audacity is rampant, one must, without a doubt, abstain from hitting his son even from a younger age. Similarly, the Ritba writes: “It seems that ‘adult’ does not necessarily mean an actual adult, rather, it all depends on the nature of the child, for we must be concerned that he will strike back, either with words or with actions. Even if he is not of Bar Mitzvah age yet, it is incorrect to cause him strike or curse his father. Rather, one should placate him with words.” Maran zt”l rules accordingly.
The Rambam writes that a schoolteacher (who, in the times of our Sages, would hit his young pupils in order to educate them) may only hit his students with a small belt in order to instill fear in them, however, he may not beat them cruelly and mercilessly; thus, he may not strike them with whips or rods. Maran Harav Ovadia Yosef Shlit”a writes that the same certainly applies to a father as well, that he must seek to act pleasantly and mercifully with his children.
The Sefer Peleh Yo’etz (authored by Hagaon Harav Eliezer Papo, Rav in the city of Silista, province of Dobruja, Bulgaria, approximately two-hundred years ago) writes that even if the child is young, if the parents know that he does not accept authority, as is common in these times where audacity is rampant and children disobey their parents, the parents need clear thinking in order to only speak to their child in soft, pleasant tones.
Maran Rabbeinu Ovadia Yosef zt”l adds that even when one must hit his son in order to teach him a lesson, it is better for one not to do so when he is angry so as not to hit him more than is necessary as a result of his anger, for if one strikes his child needlessly, his sin is too great to bear, as one who raises his hand to strike his fellow is considered wicked. One must also use wisdom to prevent terrible situations from arising as a result of this, G-d forbid, such as children reporting their parents who hit them to the police, which has happened before.
We must point out though that according to some Torah scholars in our generation (such as Hagaon Harav Shlomo Wolbe zt”l), in our times, one should not hit his children at all, for this can cause an unhealthy and cold relationship to be formed between parents and their children which can lead to very serious ramifications for the duration of the children’s lives. Experience shows that parents who educate their children sternly and in an unyielding way generally tend to see their sons and daughters straying from the proper path and rejecting all that is good and holy to their parents. This is besides the emotional distance between the children and their parents and the lack of involvement of the parents in their children’s lives. All this is because a child in our generation cannot identify with a person who raises him harshly. On the other hand, when a parent educates his children slowly and pleasantly with patience and understanding, he merits having a much more positive kind of connection with his children such that even when they grow older, he will still be able to find the way to their hearts in order to influence them to follow the proper path of growth in spirituality.
Thus, all parents must act wisely when it comes to raising one’s sons and daughters, and one must constantly pray to Hashem that He guide him on the proper path so that he may attain spiritual fulfillment from his children. Mothers must also beseech Hashem that they merit raising their children on the path of the Torah and fear of Heaven, and that it be plain for all to see that their children are the blessed children of Hashem.

who come from all over the country.
Obviously, this many visitors to the area raises the potential for incidents to occur
and this is one of the reasons the organisers arrange for so many security personnel
in the area over the two days of the festival.
Therefore, we kindly ask the kahal to be vigilant and ensure the usual security steps are taken
whilst tefillot, avot ubanim or learning sessions are taking place
i.e. ensure all doors to the building are properly closed.

Korach, Datan and Aviram, and 250 leaders of Israel rebel against the authority of Moshe and Aharon. The rebellion results in their being swallowed by the earth. Many resent their death and blame Moshe. G-d's “anger” is manifest by a plague that besets the nation, and thousands perish. Moshe intercedes once again for the people. He instructs Aharon to atone for them using the incense, and the plague stops.
Then, G-d commands that staffs, each inscribed with the name of one of the tribes, be placed in the Mishkan. In the morning, the staff of Levi, bearing Aharon's name, sprouts, buds, blossoms and yields ripe almonds. This provides Divine confirmation that Levi's tribe is chosen for priesthood and verifies Aharon's position as Kohen Gadol, High Priest. The specific duties of the levi'im and kohanim are stated. The kohanim were not to be landowners, but were to receive their sustenance from the tithes and other of the mandated gifts brought by the people. Also in this week's Torah portion are laws of the first fruits, redemption of the firstborn and various laws of offerings.
שאלה: האם מותר למלאת מים בתבנית ולהכניסם למקפיא בשבת לעשותם קרח?
תשובה: בגמרא במסכת שבת (צה.) אמרו, מגבן (פירוש, עושה גבינה) חייב משום בונה, דהיינו המקבץ פתיתי חלב ביחד לעשות מהם גבינה בשבת חייב, משום שיש בזה איסור משום מלאכת “בונה”. ומכאן יש שכתבו ללמוד שיש איסור להכין קרח בשבת, משום שעושה מהמים גוש, והרי זה אסור משום בונה.
אולם מרן הרב עובדיה יוסף זצ”ל כתב, שאין להוכיח כן מהסוגיא במסכת שבת, משום שהמגבן הוא מקבץ במו ידיו חלקים רבים והופכם לגוף אחד על ידי נתינתם בכלי עגול או מרובע כפי רצונו, והרי זה דומה לבונה שמקבץ עפר ואבנים ועושה מהם בנין אחד, וכמו שהסביר הרמב”ם (בפ”ז מהלכות שבת הלכה ו) “שכל המקבץ חלק אל חלק ודיבק (והדביק) הכל עד שיעשו לגוף אחד, הרי זה דומה לבנין”. אבל הנותן מים או מיץ במקום קר מאוד ועל ידי כך הם קופאים מעצמם אינו דומה כלל לבונה, שהרי הוא אינו עושה דבר במו ידיו.
ועוד הוסיף מרן הרב עובדיה יוסף זצ”ל טעם להקל בהכנת קרח בשבת, שהרי בנין הקרח אינו דבר המתקיים, שהרי בהוצאתו מהמקפיא מייד הוא נמס, מה שאין כן הגבינה שעומדת בפני עצמה לימים רבים, ואדרבא, כל זמן שהיא עומדת היא מתקשה יותר (כפי שאכן אנו רואים בבירור בגבינות קשות וחצי קשות) והולכת ומתקשה כאבן והרי זה דומה באמת לבנין שעומד על תילו לימים רבים.
ולכן לענין הלכה, מותר להכניס ביום שבת מים או כל משקה אחר למקפיא כדי להפוך אותו לקרח, ובפרט בימי הקיץ החמים שיש בזה משום עונג שבת. וכן העלה להקל הגאון רבי אליעזר יהודה ולדנברג זצ”ל בשו”ת ציץ אליעזר (חלק ו' סימן לד) והגאון רבי שמואל הלוי ואזנר זצ”ל בשו”ת שבט הלוי (ח”א סימן קיט).
Making Ice Cubes on Shabbat
Question: May one fill up an ice tray with water and place it in the freezer in order to make ice cubes on Shabbat?
Answer: The Gemara (Shabbat 95a) states that one who makes cheese on Shabbat by clumping together milk flakes has transgressed the Torah prohibition of building on Shabbat. Some deduce from this Gemara that it is forbidden to make ice on Shabbat, for one is turning water into a solid form and this constitutes the forbidden work of building on Shabbat.
Nevertheless, Maran Rabbeinu Ovadia Yosef zt”l writes that the aforementioned Gemara does not apply here, for one who makes cheese must collect many pieces of milk with his hands and then turns them into one block by placing them into a single round or square vessel which is indeed similar to building whereby one collects dirt, sand, and wood and creates a single building out of them. Indeed, the Rambam (Chapter 7 of Hilchot Shabbat, Halacha 6) states: “One who collects many different articles and sticks them together until they are one form, this is similar to building.” However, if one places water or juice in a cold place such that they freeze on their own, this is in no way similar to building, for one is not doing any action with his hands.
Another reason Maran zt”l adds for leniency regarding making ice cubes on Shabbat is that the “building” of ice is not something that is long-lasting, for as soon as it is removed from the freezer, it will immediately begin melting as opposed to cheese which can last on its own for a long time. Indeed, the longer it stands, the harder it becomes (as we can see with regards to hard and semi-hard cheeses) until it actually becomes as hard as a rock; this occurrence is certainly comparable to a building which is made to last for a long time.
Thus, halachically speaking, one may place water or any other beverage in the freezer in order to turn it into ice on Shabbat. This is especially true during the summer during which this constitutes enjoyment of Shabbat as well. Hagaon Harav Eliezer Yehuda Waldenberg zt”l (Responsa Tzitz Eliezer, Volume 6, Chapter 34) and Hagaon Harav Shmuel Ha’Levi Wosner zt”l (Responsa Shevet Ha’Levi, Volume 1, Chapter 119) rule likewise.

At the insistence of the Bnei Yisrael, and with G-d's permission, Moshe sends 12 scouts, one from each tribe, to investigate Canaan. Anticipating trouble, Moshe changes Hoshea's name to Yehoshua, expressing a prayer that G-d not let him fail in his mission. They return 40 days later, carrying unusually large fruit. When 10 of the 12 state that the people in Canaan are as formidable as the fruit, the people are discouraged. Calev and Yehoshua, the only two scouts still in favor of the invasion, try to bolster the people's spirit. The nation, however, decides that the Land is not worth the potentially fatal risks, and instead demands a return to Egypt. Moshe's fervent prayers save the nation from Heavenly annihilation; however, G-d declares that they must remain in the desert for 40 years until the men who wept at the scouts' false report pass away. A remorseful group rashly begins an invasion of the Land, basing themselves upon G-d's original command. Moshe warns them, but they ignore this and are massacred by the Amalekites and Canaanites.
G-d instructs Moshe concerning the flour and wine offerings to be made when BneiYisrael will finally enter the Land. The people are commanded to remove challah, a gift for the kohanim, from their dough. The laws for an offering after an inadvertent sin, for an individual or a group, are explained. However, should someone blaspheme against G-d and be unrepentant, he will be cut off spiritually from his people. One man is found gathering wood on public property in violation of the laws of Shabbat and is executed. The laws of tzitzit are taught. We recite the section about the tzitzit twice a day to remind ourselves of the Exodus.
בישול אחר אפיה
ביארנו בימים האחרונים, שמותר לחמם בשבת על גבי פלאטה חשמלית, מאכל שהתבשל כבר לפני השבת. ובתנאי שהמאכל הוא יבש, כמו בורקס, פשטידה וכדומה. אבל מאכל לח, כמו מרק ירקות, אין לחממו בשבת. והטעם לכל זה, משום שיש בידינו כלל, ש”אין בישול אחר בישול”, כלומר, דבר שכבר התבשל לפני שבת, אין איסור לחזור ולחממו בשבת, מפני שאין זה “בישול”, אלא “חימום”. אבל דבר לח, אף על פי שהתבשל כבר לפני השבת, שייך בו איסור בישול פעם נוספת. ובקצרה: “יש בישול אחר בישול בלח, ואין בישול אחר בישול ביבש”.
לפיכך למדנו גם, שמותר לקחת דבר שהתבשל לפני שבת, ולהניח אותו בתוך תבשיל אחר כשהוא רותח בשבת. ולדוגמא, מותר לקחת ביצה מבושלת, ולהניח אותה בתוך כלי עם מים רותחים בשבת. וכן מותר לקחת חתיכת בשר מבושל, ולהניחה בתוך כלי רותח על גבי הפלאטה, שהרי “אין בישול אחר בישול”.
ומעתה עלינו לבאר פרט נוסף. האם דבר שנאפה לפני השבת, שייך בו איסור בישול כאשר חוזרים לבשל אותו בשבת? כלומר, האם יש בישול אחר אפיה, או שגם אחרי אפיה לא שייך שוב דין בישול בשבת? ולדוגמא, פשטידה שאפו אותה בתנור ביום שישי, האם מותר לחמם אותה בתוך תבשיל רותח בשבת, או שאסור לעשות כן?
ושאלה זו נוגעת לא רק למאכל שנאפה, אלא גם למאכל שנצלה לפני שבת, כמו בשר צלוי, (וכן דבר שקלו אותו לפני השבת, כמו גרעינים שקלו אותם לפני השבת), האם אומרים לגביהם ש”אין בישול אחר בישול”, או שלגבי דברים כאלה שייך איסור בישול כאשר חוזרים ומבשלים אותם?
ובדבר זה נחלקו רבותינו הראשונים. שרבינו אליעזר ממיץ בספר יראים (סימן קב) כתב, שאף על פי שאין בישול אחרי בישול, מכל מקום יש בישול אחרי צלי, וכן יש בישול אחרי אפיה. והביא ראיה לדבריו. והוסיף, שלכן יזהר אדם שלא לשים פת אפויה בתוך התבשיל, ואם עשה כן, חילל שבת.
אולם לעומת זאת, הראבי”ה דחה את דברי רבי אליעזר ממיץ בענין זה, והביא גם הוא ראיה חזקה להקשות על דברי רבי אליעזר ממיץ. ומרן הבית יוסף (בסימן שיח) כתב, שהקושיא שהקשה ראבי”ה על דברי רבינו אליעזר ממיץ, היא קושיא חזקה.
ובשלחן ערוך (סימן שיח סעיף ה) פסק מרן בזו הלשון: יש מי שאומר שדבר שנאפה או נצלה, אם בישלו אותו אחר כך, יש בו איסור משום בישול. ויש מתירין. עד כאן. והרמ”א הוסיף על זה: ונהגו להזהר לכתחילה שלא לשים פת שנאפתה בתוך תבשיל חם.
ולמעשה מרן רבינו עובדיה יוסף זצ”ל (יביע אומר ח”ח סימן לה, חזו”ע שבת ח”ד עמוד שו) פסק בזו הלשון: דבר שנאפה או נצלה, מותר מן הדין לשים אותו אפילו בתבשיל רותח ממש. שאין בישול אחרי אפיה או צלייה. והמחמיר בזה תבוא עליו ברכה. ואחינו האשכנזים נוהגים להחמיר בכל זה כדעת הרמ”א.
והגאון רבי שלמה זלמן אוירבך זצ”ל הוסיף (שלחן שלמה ח”ב עמוד שכ), ש”קוגל” של אטריות, שמבשלים את האטריות לפני שאופים את הקוגל, דינו כדבר שהתבשל. ולכן גם למנהג האשכנזים מותר להניח אותו בתוך דבר רותח בשבת. וכן שקדי מרק, שמטגנים אותם בשמן לפני שבת, דינם כדבר מבושל ולא כדבר אפוי, ומותר להניחם בתוך המרק בשבת.

Cooking After Baking
Throughout the past few days, we have explained that it is permissible to warm up a food that was fully-cooked before Shabbat on an electric hotplate on Shabbat as long as the food is dry, such as bourekas, kugels, and the like. Nevertheless, a liquid dish, such as soup and the like, may not be reheated on Shabbat. The reason for this is because of the law that “there is no cooking after cooking,” i.e. once something has been cooked before Shabbat, there is no prohibition to recook it on Shabbat, for this is considered warming, not cooking. However, the prohibition of recooking on Shabbat does apply to liquid dishes even if they were fully-cooked before Shabbat.
Based on the above, we have also discussed that it is permissible to take a food that was fully-cooked before Shabbat and immerse it into another boiling food on Shabbat. It is therefore permissible to place a hard-boiled egg into a pot of boiling water on Shabbat. It is likewise permissible to take a piece of fully-cooked meat and place it into a pot of boiling food on the electric hotplate on Shabbat since “there is no cooking after cooking.”
We must now discuss another aspect of this law. Does the prohibition of cooking on Shabbat apply to something which was already baked? For instance, if a kugel was baked in the oven before Shabbat, may if be reheated in a boiling pot of food on Shabbat?
The above question does not only apply to baked goods and would apply to grilled and roasted items as well. For instance, does the prohibition of “cooking after cooking” to such items, like a grilled steak or roasted nuts,” when reheated on Shabbat on an electric hotplate or not?
Indeed, the great Rishonim disagree regarding this issue. Rabbeinu Eliezer of Metz writes in his Sefer Yere’im (Chapter 102) that although there is no cooking after cooking, there is nevertheless cooking after grilling and baking. He proceeds to bring proofs to his opinion. He adds that for this reason, one must be careful not to immerse baked bread into a hot dish and if one has done so, this constitutes Shabbat desecration.
On the other hand, Ra’avaya (Rabbeinu Eliezer bar Yoel Ha’Levi) rebuffs the Sefer Yere’im’s opinion with a strong proof of his own. Maran Ha’Bet Yosef (Chapter 318) writes that the Ra’avaya’s question on Rabbeinu Eliezer of Metz is a strong one.
In Shulchan Aruch (Chapter 318, Section 5), Maran rules, as follows: “There is someone who says that something which was baked or grilled and later cooked on Shabbat, this constitutes the prohibition of cooking on Shabbat. Others permit this.” The Rama adds: “It is customary to be careful whenever possible not to place bread into a hot dish of food.”
Halachically speaking, Maran Rabbeinu Ovadia Yosef zt”l (in his Responsa Yabia Omer, Volume 8, Chapter 35 and Chazon Ovadia- Shabbat, Volume 4, page 306) rules, as follows: “According to the letter of the law, it is permissible to immerse something which has been baked or grilled into even a boiling dish of food. One who acts stringently and abstains from doing so is especially praiseworthy. Nevertheless, our Ashkenazi brethren customarily rule stringently on this matter, in accordance with the ruling of the Rama.”
Hagaon Harav Shlomo Zalman Auerbach zt”l (in his Shulchan Shlomo, Volume 2, page 320) adds that “Lukshen” or “Yerushalmi” kugel made from noodles that were cooked before the kugel as a whole was baked is considered a cooked food. Thus, even according to the Ashkenazi custom, it will be permissible to place such a kugel into a boiling dish of food on Shabbat. Similarly, croutons which were fried before Shabbat are considered a cooked food, not a baked good, and may be added to a hot soup on Shabbat.
Summary: According to the Sephardic custom, it is permissible to place a food baked before Shabbat into a boiling dish of food on Shabbat according to the letter of the law. However, the Ashkenazi custom is to act stringently in this regard.

Aharon is taught the method for kindling the Menorah. Moshe sanctifies the levi'im to serve in the Mishkan. They replace the firstborn, who were disqualified after sinning through the golden calf. The levi'im are commanded that after five years of training they are to serve in the Mishkan from ages 30 to 50. Afterwards, they are to engage in less strenuous work.
One year after the Exodus from Egypt, Hashem commands Moshe concerning the korban Pesach. Those ineligible for this offering request a remedy, and the mitzvah of Pesach Sheini — allowing a “second chance” to offer the korban Pesach, one month later — is detailed. Miraculous clouds that hover near the Mishkan signal when to travel and when to camp. Two silver trumpets summon the princes or the entire nation for announcements. The trumpets also signal travel plans, war or festivals. The order in which the tribes march is specified.
Moshe invites his father-in-law, Yitro, to join the Jewish People, but Yitro returns to Midian. At the instigation of the eruv rav — the mixed Egyptian multitude who joined the Jewish People in the Exodus — some people complain about the manna. Moshe protests that he is unable to govern the nation alone. Hashem tells him to select 70 elders, the first Sanhedrin, to assist him, and informs him that the people will be given meat until they will be sickened by it. Two candidates for the group of elders prophesy beyond their mandate, foretelling that Yehoshua instead of Moshe would bring the people to Canaan. Some protest, including Yehoshua, but Moshe is pleased that others have become prophets. Hashem sends an incessant supply of quail for those who complained that they lacked meat, and a plague punishes those who complained.
Miriam tries to make a constructive remark to Aharon, which also implies that Moshe is only like other prophets. Hashem explains that Moshe's prophecy is superior to that of any other prophet and punishes Miriam with tzara'at, as if she had gossiped about her brother. (Because Miriam is so righteous, she is held to an incredibly high standard.) Moshe prays for Miriam to be healed, and the nation waits until she is cured before traveling.

Insulation on Shabbat
Question: Is it permissible to cover a pot of food on an electric hotplate with a towel on Shabbat?
Answer: Long ago, it was customary to cover a pot of food with (or immerse it in) dirt or sand in order to retain the food’s heat.
Heat Increasers vs. Heat Retainers
Some would immerse the pot of food into a substance that would add to the heat of the food, such as the sediment of olives or sesame seeds. Others would cover the pot of food with clothing which is considered a covering which merely retains the food’s heat but does not add heat. Covering it with olive or sesame sediment, however, not only retains heat but adds heat as well.
The Prohibition to Insulate Using Heat Increasers
Our Sages enacted that one may not cover a pot of food with something which adds heat even before the onset of Shabbat lest one see that the food is not hot enough and this will cause him to cover the pot with embers containing live coals which would constitute transgressing a Torah prohibition. It is therefore forbidden to insulate a pot with olive sediment, salt, and any other substance which adds heat even before Shabbat. However, insulating a pot with clothing, pillows, blankets, or anything else which does not add heat is permissible before the onset of Shabbat.
Insulation Using Heat Retainers
Nevertheless, on Shabbat itself, one may not insulate the pot even with things that do not add any heat lest one find the food to be cold and this will cause one to heat it up in a forbidden manner. It is therefore forbidden to cover a pot containing hot food on Shabbat in order to retain its heat. It is certainly forbidden to cover a pot of food on the hotplate with clothing or towels on Shabbat in order to hasten its cooking and heating time.
All of the applies on Shabbat. Before the onset of Shabbat, however, it is permissible to insulate a pot of food with a substance that merely retains heat, such as clothing. It is therefore permissible to cover a pot of food on the hotplate with a towel before the onset of Shabbat since the towel does not add any heat. In the following Halachot, we shall, G-d-willing, summarize and explain these laws further.

The Torah assigns the exact Mishkan-related tasks to be performed by the families of Gershon, Kehat, and Merari, the sons of Levi. A census reveals that over 8,000 men are ready for such service. All those ritually impure are to be sent out of the encampments.
If a person, after having sworn in court to the contrary, confesses that he wrongfully retained his neighbor’s property, he has to pay an additional fifth of the base-price of the object and bring a guilt offering as atonement. If the claimant has already passed away without heirs, the payments are made to a kohen.
In certain circumstances, a husband who suspects that his wife had been unfaithful brings her to the Temple. A kohen prepares a drink of water mixed with dust from the Temple floor and a special ink that was used for inscribing G-d's Name on a piece of parchment. If she is innocent, the potion does not harm her, but, rather, it brings her a blessing of children. If she is guilty, she suffers a supernatural death.
A Nazir is one who vows to dedicate himself to G-d for a specific period of time. He must abstain from all grape products, grow his hair and avoid contact with corpses. At the end of this period he shaves his head and brings special offerings. The kohanim are commanded to bless the people. The Mishkan is completed and dedicated on the first day of Nissan in the second year after the Exodus. The prince of each tribe makes a communal gift to help transport the Mishkan, as well as donating identical individual gifts of gold, silver, animal and meal offerings.

אחר בשר, אלא אם ישהה שיעור שבין סעודה לסעודה. (ועל סגנון דברי
הגמרא, נדון בהלכה הבאה).

נחלקו
רבותינו הראשונים כמה זמן יש להמתין, שדעת רבינו תם, שמותר לאכול גבינה מיד אחרי
אכילת בשר, ובלבד שינקה את פיו ואת ידיו. ולשיטתו צריך לפרש, שמר עוקבא שהיה ממתין
מסעודה לסעודה, מחמיר על עצמו היה, ואמר על עצמו שאינו מחמיר כל כך כמו אביו. אבל
אין בהמתנה זו חיוב מן הדין. אולם רוב הראשונים חלקו על דברי רבינו תם, ובהם:
הרי”ף, והרמב”ם ועוד. ופירשו שמה שהיה מר עוקבא ממתין שיעור זמן “שבין
סעודה לסעודה”, מן הדין היה עושה כן, ואמר שאינו נוהג חומרא כמו אביו שהיה
ממתין עשרים וארבע שעות. וכן פסק מרן השולחן ערוך, שמן הדין יש להמתין שיעור זמן
שבין סעודה לסעודה.
וכמה
הוא שיעור הזמן שבין סעודה לסעודה שיש להמתין? דעת התוספות, שאין קצבה לשיעור זה,
אלא כל שסיים את סעודתו, כגון שכבר פינו את השולחן, רשאי לאכול מאכלי חלב אחרי
מאכלי בשר.
אולם
דעת רוב הראשונים, שיש להמתין שש שעות בין אכילת בשר לאכילת גבינה, שזהו ההפרש בין
סעודה לסעודה שאמר מר עוקבא. וכן דעת הרמב”ם, שיש להמתין שש שעות, וכן פסק
מרן השלחן ערוך, וגם הרמ”א כתב שכך נכון לעשות, אף על פי שיש חולקים. ואף שיש
מן האשכנזים שמיקלים בפחות משש שעות, כתב מרן החיד”א, שבגלילותינו המנהג פשוט
לכל אדם להמתין שש שעות. וכתב המהרש”ל (רבי שלמה לוריא מגדולי פוסקי אשכנז
סמוך לזמן מרן) שאף למנהג האשכנזים, כל מי שיש בו ריח תורה ראוי לו להחמיר להמתין
שש שעות. ובספר ערוך השולחן (להגאון רבי יחיאל מיכל אפשטיין לפני למעלה ממאה שנים)
כתב שכיום אף מנהג רוב האשכנזים להחמיר בזה, וחלילה לשנות.
מדוע
יש להמתין בין אכילת בשר לגבינה
וטעם
הדבר שלא לאכול גבינה אחרי בשר הוא משום בשר שנכנס בין השינים, ויש לחוש שכאשר
יאכל גבינה, יצא הבשר מבין שיניו ונמצא אוכל בשר וגבינה ביחד, וכך היא דעת
הרמב”ם. אולם לשיטת רש”י והרא”ש הטעם הוא מפני שהבשר מוציא טעם בפה
זמן ארוך. ולהלכה אנו נוקטים כשני הטעמים, ולכל הדעות אחרי שש שעות יכול לאכול
גבינה, ואף לשיטת הרמב”ם שסובר שיש לחוש לבשר שבין השינים, מכל מקום אחרי שש
שעות הבשר נחשב כבר מעוכל ואין לחוש לו. ומכל מקום אם יודע בפירוש שיש בשר בין
שיניו, צריך להסירו אף לאחר שש שעות.

Question: Is one obligated to wait six hours after eating
meat foods before eating dairy foods?
Answer: The Gemara in Masechet Chullin
(105a) states: “Mor Ukva said: When my father would eat meat, he would not
eat cheese until the next day. Regarding myself, however, within the same meal
I do not eat meat and then cheese, but I would eat cheese during the next
meal.” The Rif writes that we learn from here that one may eat cheese
after meat only after having waited the amount of time that is between one meal
and the next. (We shall deal with the Gemara's wording in the next Halacha,
G-d-willing.)
How Much One Must Wait Between Eating Meat and Dairy
The Rishonim disagree regarding exactly how much time one must wait. Rabbeinu
Tam is of the opinion that one may eat cheese immediately after eating meat as
long as one has washed out his mouth and cleaned his hands. Based on this, Mor
Ukva who would wait from one meal to the next was acting stringently about
which he exclaimed that he did not act as stringently as his father.
Nevertheless, this wait is not a halachic requirement. However, most Rishonim,
including the Rif, Rambam, and others, disagree with Rabbeinu Tam's opinion.
They understand that when Mor Ukva waited the amount of time “between one
meal and the next,” this was indeed a halachic requirement to which he
exclaimed that he did not act as stringently as his father who would wait
twenty-four hours. Indeed, Maran HaShulchan Aruch rules likewise that
halachically speaking, one must wait the amount of time that is “between
one meal and the next.”
What is the amount of time “between one meal and the next” that one
must wait? The Tosafot write that there is no actual time limit and as long as
one has concluded his meal, such as by clearing the table, one may eat dairy
foods after meat.
Nevertheless, most Rishonim agree that one must wait six hours between eating
meat and dairy foods, for this is the amount of time “between one meal and
the next” that Mor Ukva was speaking about. This is indeed the opinion of
the Rambam and Maran HaShulchan Aruch that one must wait six hours. The Rama
writes that this is indeed the correct opinion to follow although there are
dissenting views. Although there are certain Ashkenazi communities who act
leniently and wait less than six hours, Maran Ha'Chida writes that in our
communities, the established custom is for everyone to wait six hours. The
Maharshal (Hagaon Rabbeinu Shlomo Luria, one of the greatest Ashkenazi Poskim
close to the generation of Maran) writes that even according to the Ashkenazi
custom, anyone who has a “scent of Torah” within him should wait six
hours. The Sefer Aruch HaShulchan (authored by Hagaon Harav Yechiel Michel
Epstein zt”l who lived over one-hundred years ago) writes that
nowadays, the prevalent custom among most Ashkenazim as well is to wait six
hours and one should not change this, G-d-forbid.
The Reason to Wait between Eating Meat and Dairy Foods
The reason why eating cheese after meat is prohibited is because meat gets
stuck in between the teeth and we are concerned that when one eats cheese, the
meat caught in between one's teeth will become dislodged thereby causing one to
be eating meat and cheese together. This is indeed the Rambam's opinion. On the
other hand, Rashi and the Rosh explain that the reason is because meat gives
off a taste in one's mouth for a long time. Halachically speaking, we follow
both opinions and after six hours, one may eat cheese. Even according to the
opinion of the Rambam who is concerned for meat get stuck in one's teeth, after
six hours, the meat is considered digested and poses no concern anymore.
Nevertheless, if one is aware of a piece of meat stuck in his teeth, one must
remove it even after six hours have passed.

Here are seven reasons why we read the Megillah of Ruth on Shavuot:
- The events occurred during the harvest season. Shavuos is the harvest festival.
- Ruth was a convert to Judaism. Conversion is an individual Kabbalas HaTorah.
- Ruth the Moabite was permitted to marry Boaz, based on a drasha (a teaching of the Oral Law) of the verse, “A Moabite may not marry into the Congregation of Hashem” (Devarim 23:4). This hints at the unity between the Written Torah and the Oral Torah.

לפיכך, מותר לעשות ביום טוב מדורה בכדי להתחמם כנגדה בימי הקור, שהרי היא הנאה השווה לכל נפש, שכל בני האדם זקוקים לחימום. (ובתנאי שלא יבעיר אש חדשה, אלא יעביר אש מאש הדלוקה כבר).
ומטעם זה מותר גם כן לחמם מים ביום טוב (באמצעות בוילר חשמלי שהופעל מערב יום טוב, לפני שקיעת החמה), בכדי לרחוץ בהם את פניו ידיו ורגליו, שהיא הנאה “השוה” לכל נפש. אבל אסור לחמם מים בכדי לרחוץ את כל גופו, שאין זו הנאה השווה לכל נפש, לרחוץ את כל גופו בכל יום ויום.
ומכל מקום, הואיל ואין איסור עצמי לרחוץ את כל גופו ביום טוב במים חמים, רק האיסור הוא מצד צורת חימום המים ביום טוב, לכן, מים שהוחמו מערב יום טוב (כלומר לפני שקיעת החמה בערב יום טוב), מותר לרחוץ בהם כל גופו ביום טוב, שלא גזרו בזה רבותינו איסור אלא בשבת, כמו שביארנו כבר בהלכות שבת. וכמו כן מים שהוחמו על ידי דוד שמש ביום טוב עצמו, מותר לרחוץ בהם כל גופו ביום טוב. (וכל זה דוקא באמבטיה פרטית בביתו של כל אדם, אבל בבית המרחץ ציבורי, כגון בפנימיה שיש שם כמה מקלחות, אין להקל לרחוץ במים חמים ביום טוב אפילו רק פניו ידיו ורגליו, הואיל וגזרו בזה רבותינו איסור בזה, מפני שהבלנים האחראים על בתי המרחץ היו מזלזלים ומחממים מים באיסור(.
ולסיכום: מותר לרחוץ כל גופו ביום טוב במים חמים שהוחמו על ידי בוילר מערב יום טוב, או במים שהוחמו על ידי דוד שמש אפילו ביום טוב עצמו. ודין זה הוא דוקא באמבטיה פרטית שבביתו של כל אדם. אבל מים שהוחמו ביום טוב עצמו על ידי בוילר חשמלי שהודלק מערב יום טוב וממשיך את פעולתו ביום טוב עצמו, אסור להשתמש בהם ביום טוב לרחיצת כל גופו, אבל מותר לרחוץ במים הללו, את פניו ידיו ורגליו.
ולשאלת רבים, בדבר מים שהוחמו מערב יום טוב על ידי בוילר חשמלי. והבוילר ממשיך לפעול ביום טוב עצמו, ועל ידי כך נשמרת חמימות המים, האם מותר להשתמש במים אלה ביום טוב?
שאלנו על כך את מרן רבינו עובדיה יוסף זצ”ל, והשיב, שאם המים התחממו היטב מערב יום טוב, ופעולת הבוילר ביום טוב אינה אלא בכדי לשמור את חמימות המים, אבל לא בכדי לחממם מחדש, מותר לרחוץ בהם כל גופו ביום טוב.
ומכל מקום נראה שצריך להזהר, שלא יכנסו מים חדשים לדוד המים הרותחים, שעל ידי כך הוא מבשל את המים החדשים שנכנסים לדוד המים החשמלי. ועל כן עיקר ההיתר בדבר, הוא דוקא באופן שסוגר את ברז המים המזרים מים לדוד, בכדי שלא יכנסו שוב מים צוננים לדוד החשמלי. אבל אם אינו סוגר את ברז המים, לכאורה אין להקל בדבר. ועוד חזון למועד.
Showering on Yom Tov
Question: Is it permissible to take a hot shower on Yom Tov (i.e. Pesach, Shavuot, and Sukkot)?
Answer: We have previously established that although Yom Tov is equal to Shabbat regarding the prohibition of work, nevertheless, there are some forms of work which may be performed on Yom Tov, provided that they are works are enjoyable by all. Thus, one may cook something on Yom Tov to be eaten on Yom Tov itself, as long as he does not create a new fire on Yom Tov, rather, he should use a flame from a pre-existing fire.
Additionally, one may light a bonfire on Yom Tov in order to use it for warmth during the cold season, since this is considered an “enjoyment equal to all” (meaning everyone enjoys such a thing), as all indeed require warmth (once again, provided that one does not create a new fire, rather, only transfers a flame from a pre-existing fire.)
For the same reason, one may heat water on Yom Tov (using an electric/gas boiler that was already turned on from before sunset on Erev Yom Tov) in order to wash his face, hands, and feet, for this too is considered an “enjoyment equal to all.” However, one may not heat water on Yom Tov in order to wash his entire body, for washing one’s entire body daily is not considered an “enjoyment equal to all.”
Nevertheless, since the only prohibition involved here is regarding the way the water is heated on Yom Tov whereas the actual act of washing one’s entire body with hot water is not forbidden, one may indeed wash his whole body on Yom Tov with water that was heated before Yom Tov (i.e. before sunset on Erev Yom Tov), as our Sages did not ban this on Yom Tov as they did on Shabbat. Similarly, water that was heated through a solar heating tank (a.k.a. “Dud Shemesh,” common in Israel) on Yom Tov itself may be used to wash one’s entire body on Yom Tov. (All this applies only in one’s private shower at home, however, regarding a public shower room, such as in a dormitory where there are several shower stalls, one may not use the hot water from these showers even to wash his face, hands, and feet, for our Sages forbade washing with hot water in public places since the public bathhouse attendants would act derisively and heat up the water in forbidden ways.)
Summary: One may wash his entire body on Yom Tov either with water that was heated through an electric/gas boiler before the onset of Yom Tov or with water heated in a solar heating tank even on Yom Tov. This only applies, however, to one’s private shower at home. Nevertheless, water that was heated on Yom Tov itself through an electric/gas boiler that was turned on before the onset of Yom Tov yet continues to operate on Yom Tov may not be used to wash one’s entire body; however, one may use this water to wash his face, hands, and feet.
By popular request: Regarding water that was heated in an electric/gas boiler before the start of Yom Tov and the boiler continues to work on Yom Tov, causing the water to retain its heat, is it permissible to use this water on Yom Tov?
We had posed this question to Maran Rabbeinu Ovadia Yosef zt”l and his response was that if the water was heated well before the onset of Yom Tov and the boiler’s operation on Yom Tov serves only to retain the water’s heat but not to reheat it, one may use this water to wash his entire body on Yom Tov.
Nevertheless, one must take care that no new water enter the hot-water tank, for if so, by showering one is causing the new water entering the tank to be cooked. Thus, the only way it will be permissible to shower on Yom Tov (using water from an electric/gas boiler) is only if the cold-water valve, through which new water enters the hot-water tank, is shut. However, if one does not shut the cold-water valve, it seems there is no room for leniency in this matter.
